Source text - English MAJOR SCALE HARMONY
Because you can play more than one scale on a given chord, the scales presented here are in the category of “basic first choices”. Different musicians may play different scales on the same chords. Charlie Parker y John Coltrane, two giants of jazz, played different scales on half-diminished chords. Keep an open mind – and open ears.
Look at the Major Scale Harmony chart (figure 3-3). You learned about the major scale in Chapter 2, but only checked out the root, 3rd , 5th and 7th of each mode to discover what chord is derived from that mode. In this chapter, you´ll learn about all seven notes of each mode, this time from the point of view of improvisation as well as chord formation. In the process, you’ll learn more chords played by jazz musicians. In addition, you´ll learn how musicians use chord symbols not only to denote the chord to be played but also to indicate what scale to play on that chord. Finally, you’ll learn about extensions (9th, 11th, 13th) and alterations (b9, #9, #11, b5, ,b13).
Extension numbers are always confusing at first. Look at figure 3-4 which shows a D-7 chord, E, the “9th” on the D-7 chord is a 2nd above D, is it not? G, the “11th” is a 4th above D. And B, the “13th”, is a 6th above D. Why not call E, G and B the 2nd, 4th and 6th? Because chords are usually built in 3rds, and to keep this continuity going, numbers bigger than “7” are needed. Here are a few simple rules to memorize:
a. The 9th of a chord is the same note as the 2nd
b. The 11th of a chord is the same note as the 4th
c. The 13th of a chord is the same note as the 6th
The Ionian mode and the Major 7th chord.
Figure 3-3 shows the C major scale in all its modes, Ionian, Dorian, Prhygian, Lydian, and so on. Lets look at the first. Or Ionian, mode, which goes with some kind of C chord. What kind of a 3rd and 7th does it have? Because it has a major 3rd and a major 7th, its the mode for a C∆ .
The major scale can sound majestic, like joe Henderson as he plays an F major scale lick on Lee Morgan’s “Hocus Pocus”5 (figure 3-5). It can sound playful, as Woody Shaw does playing the G major scale on Booker Ervin’s “Lynn’s Tune”6 (figure 3-6). It can sound effusive, as Booker Ervin does playing the Eb major scale on his cadenza on Charles Mingus’ “Self Portrait In Three colors”7 (figure 3-7).
The Dorian mode and the minor 7th Chord
Now look at the second, or Dorian, mode, in figure 3-3, which runs from D to D. It goes with some kind of D chord, because it has a minor 3rd and a minor 7th, it’s the mode for a D-7 chord.
The Mixolydian Mode and the Dominant 7th chord
Skip now to the fifth, or Mixolydian, mode in figure 3-3, which runs from G to G. Because it has a major 3rd and a minor 7th it’s the mode for a G7 chord.
Tu sum up, these are the modes to play over a D-7, G7, C∆, the II-V-I progression in the Key of C:
A. On a D-7 chord, play the D Dorian mode.
B. On a G7 chord, play the G Mixolydian mode.
C. On a C∆ chord, play the C Ionian mode.
At this point, the logical question is: Why bother with modes? Since D Dorian, G Mixolydian and C Ionian are just different forms of the same C major scale, why not just think “play in C major” on D min7, G7, C Maj?
“Avoid” notes
Good question. Go to a piano and play a root position C∆ chord with your left hand while playing the C major scale with your right hand, as shown in figure 3-8. There is a note in the scale that is much more dissonant than the other six notes. Play the same chord again with your left hand while you play the 4th, F, with your right hand. Hear the dissonance? This is a so-called “avoid” note. Play the chord again, this time playing a short run in the right hand with F in the middle of it, as shown in figure 3-9. The dissonance is hardly noticeable this time, because F is now
a passing note, and is not struck or held against the chord. “Avoid note” is not a very good term, because it implies that you shouldn’t play the note at all. A better name would be a “handle with care” note. Unfortunately, that´s not as catchy, so I’ll (reluctantly) stick with the term “avoid” note.
By the way, don’t think of consonance as “good” and dissonance as “bad”. Dissonance makes music interesting, providing tension, resolution and energy. “The creative use of dissonance” might be a good way to describe the entire evolution of Western music8 The context often determines how much dissonance you play. The 4th on a major 7th chord is often played as a deliberate dissonance, usually resolving to the 3rd just below. The first note in the ninth bar of Victor Young’s “Stella By Starlight” is the Eb, the 4th of a Bb Maj chord, an “avoid” note. Play figure 3-10, and you’ll hear this starkly dissonant Eb, the 4th, resolve immediately to D, the major 3rd of Bb Maj.
If you’re playing an “outside”, or free piece, or one where there is a long section of a major chord, the 4th might just be the most interesting note you could play.
Before the bebop era, most jazz musicians, played the 4th of a major chord as a passing note only. Charlie Parker Bud Powell, Thelonious Monk, and other pioneers of bebop often raised the 4th, as shown in figure 3-11, in their improvising, chord voicings, and original tunes. It’s hard to believe now, but the raised 4th was a very controversial note during the 1940s.People actually wrote letters to Down Beat magazine about it, saying things like “the beboppers are ruining out music” and “jazz Is dead”9
The raised 4th is notated here as #4, but many musicians call it a #11 instead (remember, the 4th and the 11th are the same note). Until the 1960’s, most musicians called it a b5, but as more and more jazz musicians started thinking of scales while improvising, the term b5 gave way to #4 or #11. As you can see in figure 3-12, the 4th of the C major scale has been raised, rather than the 5th lowered.

La escala mayor puede sonar majestuosa, como Joe Henderson cuando toca un “lick” de la escala de Fa mayor en “Hocus Pocus” de Lee Morgan5 (figura 3-5), puede sonar juguetón, como Woody Shaw suena tocando la escala de Sol mayor en “Lynn´s Tune” de Booker Ervin6 (figura 3-6). A. En un acorde de D-7, tocar el modo de Re Dorio
B. En un acorde de Sol 7, tocar el modo de Sol Mixolidio
C. En una acorde de Do∆, tocar el modo de Do Iónico
En este punto, la pregunta lógica sería: ¿Por qué preocuparse con los modos?, Ya que Re Dorio, Sol, Mixolidio y Do Iónico son solo diferentes formas de la misma escala de Do Mayor, ¿Por qué no solo pensar en “tocar Do mayor” en Re menor 7, Sol 7 y Do mayor?
Notas “A evitar”
Buena pregunta, Ve a un piano y toca un acorde de Do∆ en posición natural con tu mano izquierda mientras tocas la escala de Do mayor con tu mano derecha, como se muestra en la figura 3-8. Hay una nota en la escala que es mucho mas disonante que las otras 6 notas. Toca de nuevo el acorde con tu mano izquierda mientras tocas la 4ta, Fa, con tu mano derecha. ¿Escuchas la disonancia? Esta es lo que se llama una nota “a evitar”. Toca de nuevo el acorde, esta vez tocando una frase pequeña en la mano derecha con Fa en medio de la frase, como lo muestra la figura 3-9. La disonancia casi no se nota esta vez porque Fa es una nota de paso, y no esta siendo tocada ni sostenida contra encima del acorde. “Nota a evitar” no es un muy buen término porque implica que no debes tocar la nota para nada. Un mejor nombre sería nota para “tratar con cuidado”. Desafortunadamente, no es tan pegadizo, así que me quedaré (de mala gana) con el término de nota “a evitar”.
Por cierto, no pienses en consonancia como “buena” y disonancia como “mala”. La disonancia hace a la música interesante, dándole a esta tensión, resolución y energía. “El uso creativo de la disonancia” puede ser una buena forma de describir la evolución entera de la música de occidente8 el contexto a menudo determina cuanta disonancia tocas. Source text - English Common law is generally uncodified. This means that there is no comprehensive compilation of legal rules and statutes. While common law does rely on some scattered statutes, which are legislative decisions, it is largely based on precedent, meaning the judicial decisions that have already been made in similar cases. These precedents are maintained over time through the records of the courts as well as historically documented in collections of case law known as yearbooks and law reports. The precedents to be applied in the decision of each new case are determined by the presiding judge. As a result, judges have an enormous role in shaping American and British law. Common law functions as an adversarial system, a contest between two opposing parties before a judge who moderates. A jury of ordinary people without legal training decides on the facts of the case. The judge then determines the appropriate sentence based on the jury’s verdict.
Civil Law, in contrast, is codified. Countries with civil law systems have comprehensive, continuously updated legal codes that specify all matters capable of being brought before a court, the applicable procedure, and the appropriate punishment for each offense. Such codes distinguish between different categories of law: substantive law establishes which acts are subject to criminal or civil prosecution; procedural law establishes how to determine whether a particular action constitutes a criminal act, and penal law establishes the appropriate penalty. In a civil law system, the judge’s role is to establish the facts of the case and to apply the provisions of the applicable code. Though the judge often brings the formal charges, investigates the matter, and decides on the case, he or she works within a framework established by a comprehensive, codified set of laws. The judge’s decision is consequently less crucial in shaping civil law than the decisions of legislators and legal scholars who draft and interpret the codes.

Nurturing of dissonance
The elimination of key signatures is not the result of someone´s stubbornness; simply the tonal concepts or “diatonal” that are valuable for its reaffirmation.
Key signatures in our time are an element that is way less fundamental than in the 19th Century, and furthermore, generally viewed as a “curb” to the precise and, at the same time, multiple graphics of our century.
Bartók puts a note in the edition of his “Bagatelles, Op. 6” The accidental alterations are applicable only to the notes on the same line or space and, obviously in one measure (ex. #1).
Alois Haba, the great Czech composer, goes even further. The alterations in his music are applicable only to the immediate note (ex. #2).
Also, the field of what is “tonal” has expanded itself considerably including modalism and polytonalism as extraordinarily rich expansions of what is tonal (see respective chapters).
The metric (measures) had itself to “push aside” the imaginary division bars in search of more flexibility. Implicit flexibility in the phrasing, and this, when its well understood, has changed the narrow concept of measure and strong and weak parts into the concept of “measure unity” and phrases accented by the dynamics and the writing rather than the beats and subdivisions.
In “Petroushka”, “Rite of spring” and “History of a soldier”, Stravinsky has made since 1908 an effective use of the “dynamic rhythmics”.
Erick Satie (contemporary of Debussy) had eliminated from his piano music: measures, division bars and even used to suggest hues of interpretation with poetic-literary references.
