Ich versuch mich mal daran ;-) Explanation: provided that the purchase or sale of securities on a when-issued or delayed-delivery basis, ****applied on a case by case basis and posting of securities margin with respect to the writing of options or the purchase or sale of forward or futures contracts, are not deemed to be the pledge of the assets. ... vorausgesetzt, der Kauf oder Verkauf der Wertpapiere, fallweise bei Ausstellung oder verzögerter Aushändigung und die Feststellung der Handelsspanne bzgl. der Zeichnung von Optionen oder dem Kauf bzw. Verkauf von Termingeschäften oder -kontrakten, wird nicht als das Pfand für die Vermögenswerte angesehen. Stellung von Wertpapiersicherheiten Explanation: Die gängigsten Varianten zur Bereitstellung von Margin bei Termingeschäften sind Bareinschüsse oder die Verpfändung von Wertpapieren. Sinn dieser Klausel ist es vermutlich, die Verpfändung von Wertpapieren für Termingeschäfte vom einem allgemeinen Verpfändungsverbot (das "provided..." vorhergehen dürfte) auszunehmen. |
