Not sure if you really need "the use of" here; I think just "without violence" will do. "Mediar" just means "involving", but that sounds a little odd to my ears in this construction.

agree  Taña Dalglish: https://tureng.com/en/spanish-english/delito patrimonial (esp. with regard to the reading of numeral 3). What I am unsure of though is numeral 2 (asker has "criminal negligence"); this may need a different question (imprudentes y culposos)? Stay safe.
