Although the issue is admittedly arguable, I take as my point of departure that government regulation and control are not the appropriate avenues. Without belaboring the point, I will summarize why I believe the government regulatory model is neither desirable nor achievable.
Although direct government control of media content seems to have few supporters, two lesser steps are often mentioned: first, that movement can be insulated and restrained to the point that some benevolent "regulation" would not be tantamount to "control"; and second, that "structural regulation can be applied without necessarily leading to "content" control. However, I maintain, these arguments, as well as other recommendations that government be relied on for redressing problems of access, diversity, and service, will inevitably fail, individually and collectively, on several grounds:
1. Constitutionally: Government control of the press content is, simply put, unconstitutional on its face, short of extreme cases of directly demonstrated clear and present danger. I cannot envision any kind of content regulation, however indirect, that wouldn't project government into the position of favoring or disfavoring some views and information over others. Even so-called structural steps aimed at opening channels for freer expression would post government in the intolerable role of super-gatekeeper.
2. Politically: If one defines the problem of access and diversity as Judith Lichtenberg does (in seeking voice for "perspectives other than those of a privileged and powerful minority"),25 then government seems an ironic place to turn for help. Government is by definition integrated with the power class in American society, and it is axiomatic that the press already gives greater voice to the "outs" than the government does or is likely to. De Tocqueville recognized this reality in calling the press "the chief democratic instrument of freedom."26 Part of the problem at hand is that the institutional press is already too much in alliance with the power classes; turning to government hardly alleviates the situation.
3· Pragmatically: The essays in this book originated, in part, from a perception that government regulation of broadcasting has failed. Such experimental remedies as the fairness doctrine and equal time provisions have not served to maximize social responsibility within broadcasting; by contrast, they have helped to shield broadcasters from a full and will ful embracing of the social contract with consumers. Some might argue that the solution is stronger regulation. But far Erom bolstering this conclusion, the record of government intervention so far undermines it.
4. Professionally: To impose government regulation, even with the most benign intent, on the American press would risk wrecking a fragile system that is arguably the most responsible and effective in the world, even given its imperfections. The system is animated by the ideal of First Amendment freedom from government interference; government intrusion would necessarily subvert that ideal and demolish the fundamental assumption on which the press operates. It is hard to imagine that the ensuing system would be an improvement.
If government fails as a reliable source of reform, then the only alternative seems to be reform within the press. Yet this is the same avenue recommended by the Hutchins Commission and depended on throughout history. If it hasn't succeeded so far, why should it now?
There are two possible answers. The first is that internal reform is logically the only alternative that stands a chance of working; thus, it is the place to concentrate the effort, for better or worse. The second, more important response is that journalism is a craft peculiarly suited to internal reform, if cities and would-be reformers study the system and locate the suitable levers for producing change.
Individual journalists (in contrast to journalistie institutions) are by nature independent and self-critical; that they voluntarily express and accept the social responsibility doctrine is itself an indication of goodwill that can be turned to powerful advantage. Journalists are propelled by a First Amendment syndrome, a set of beliefs (perhaps a mythology, but powerful nevertheless) that, via broad acceptance, assumes a self-fulfilling power that can drive the profession. It holds that journalists are free, responsible, and accountable. Journalists may not be "professionals" in the formal sense (under which licenses are required, for instance), but they tend to accept that their field operates under social and professional standards extending beyond immediate profit and self-interest. Journalists believe this, and in their belief resides the power to impose and sustain change.
This power can be employed effectively inside the newsroom. The news-craft sociology was described by Warren Breed, who identified six factors for achieving "social control in the newsroom." They included the power of institutional authority and actions; feelings of obligation and esteem for superiors; mobility aspirations; the absence of competing group allegiance; the pleasant nature of the activity; and the fact that news becomes a value and a continuing challenge for workers. Of the six, Breed wrote, the most powerful is the journalist's esteem for superiors; "the newsman's source of rewards is located not among the readers, who are manifestly his clients, but among his colleagues and superiors." Breed concluded: "Any important change toward a more 'free and responsible press' must stem from various possible pressures on the publisher, who epitomizes the policy making and coordinating role. "27
More recently, Ed Lambeth listed influences that shape journalists' ethics as (in order) day-to-day newsroom learning, family upbringing, senior editors, peers, journalism professors, and senior reporters. 28 Like Breed' 5, his list supports the argument' that internal newsroom influences serve as leading motivating forces for individual journalists. It therefore seems quite practical to move toward a strategy that utilizes this understanding of journalists and their workplaces to derive the greatest benefit for the social contract.

Ainda que o caso seja admissivelmente discutível, eu tomo como ponto de partida que as regulamentações e os controles governamentais não são caminhos apropriados. Sem deter-me excessivamente, recapitularei a crença de que o modelo regulatório governamental seja não somente indesejado como também seja inalcançável.
Mesmo que o controle governamental direto da imprensa pareça arrematar poucos admiradores, dois pormenores são frequentemente mencionados: primeiro, que aquele movimento possa ser separado ou contido até o ponto em que uma “regulamentação” benéfica não seja equivalente a “controle”; e segundo, que “uma regulamentação estrutural possa ser aplicada sem que necessariamente exista o controle do “conteúdo”. De qualquer maneira, mantenho que estes argumentos, bem como outras recomendações em que o papel do governo esteja em regulamentar os problemas de acesso, permissão, diversidade e serviço, inevitavelmente irão fracassar tanto individualmente quanto coletivamente sob muitos dos seguintes aspectos:

3· Pragmaticamente: As dissertações deste livro se originaram em parte pela percepção de que a regulamentação das transmissões da imprensa falharam. Remédios empíricos como a doutrina da justiça e as provisões de igualitariedade não serviram para aumentar a responsabilidade social da imprensa; em justaposição, estes auxiliaram a separá-la de um maior contrato social para com seus consumidores. Alguns até discutem se a solução seria uma maior regulamentação. Mas muito longe de reforçar esta conclusão, o registro histórico da intervenção governamental, enfraquece este preceito.
4. Profissionalmente: Forçar uma regulamentação governamental, mesmo que com a mais altruísta das intenções, enfraqueceria o sistema fragilizado da imprensa Americana que, argumentávelmente, mesmo dadas suas imperfeições, é o mais responsável e eficaz do mundo. O sistema é inspirado pelo ideal da Primeira Emenda, liberdade contra interferência do governo; a intrusão governamental subverteria tal ideal e destruiria a ordem fundamental sob qual a imprensa opera. É difícil imaginar que o sistema subsequente fosse um aperfeiçoamento.
Se o governo falha como uma fonte confiável de reforma, então a única alternativa seria a reforma da imprensa pela imprensa. Ainda, este é o mesmo caminho recomendado pela Comissão Hutchkins e consentido através da história. Se não vingou até hoje porque vingaria agora?
Existem duas respostas possíveis. A primeira sugere que uma reforma interna é lógicamente a única alternativa com uma chance de êxito, portanto, quer seja para melhor ou para pior, é neste ponto que os esforços se devem concentrar.
A segunda resposta, e a mais importante, é que o jornalismo é uma profissão especialmente destinada à uma reforma interna; se as cidades e os futuros reformadores estudarem o sistema e localizarem seus pontos niveladores, estes podem produzir mudanças.
