حيث ان الوقائع – على ما يبين من الحكم المطعون فيه وسائر أوراق الطعن وفي حدود ما يقتضيه الفصل فيه – تتحصل في أن المطعون ضده أقام الدعوى 84/2007 عمال جزئي العين على المؤسسة الطاعنة بطلب الحكم بالزامها بأداء رواتبه وأجوره عن الأحد عشر شهراً الأخيرة وبدل الاجازة عن مدة عمله و20% نسبته من أرباح المشروعات التي قام بأدائها وبدل العمل الاضافي عن مدة عمله ومكافأة نهاية الخدمة وتذكرة سفر الى موطنه. على سند من أنه عمل لديها في وظيفة مدير اداري ومهندس براتب شهري قدره 2700 درهم اعتباراً من 1/5/1995 ولم يتسلم مستحقاته المشار اليها و20% من أرباح كل مشروع، فكانت الدعوى.
ومحكمة أول درجة ندبت خبيراً وبعد أن قدّم تقريره الأصلي أقامت الطاعنة دعوى متقابلة بطلب الحكم بإلزام المطعون ضده برد مبلغ 80.000 درهم اقترضها منها وامتنع عن ردها. وبعد أن قدم الخبير المنتدب تقريره التكميلي، قضت المحكمة في 14/4/2008 في الدعوى الأصلية بالزام الطاعنة بأن تؤدي للمطعون ضده مبلغ 97843 درهماً وتذكرة عودة، وفي الدعوى المتقابلة برفضها.
استأنف المطعون ضده والطاعنة هذا الحكم بالاستئنافين 133، 151 لسنة 2008 العين، ومحكمة الاستئناف قضت في 8/7/2008 بتأييد الحكم المستأنف، فكان الطعن.
حيث ان النص في المادة 173/1 من قانون الاجراءات المدنية – بعد تعديلها بالقانون رقم 30/2005 الصادر في 30 نوفمبر 2005 والمعمول به من تاريخ نشره في 14 ديسمبر 2005 والمنطبق على واقعة الدعوى على أن "للخصوم أن يطعنوا بالنقض في الأحكام الصادرة من محاكم الاستئناف اذا كانت قيمة الدعوى تجاوز مائتي الف درهم أو كانت غير مقدرة القيمة "يدل على أنه لا يجوز الطعن في أحكام محاكم الاستئناف الصادرة بعد العمل بالقانون رقم 30/2005 إلا إذا كانت قيمة الدعوى تجاوز مائتي ألف درهم أو كانت غير مقدرة القيمة.
وكان من المقرر بنص المادة 49/1 انه اذا لم تذكر القيمة بالنقد وكان بالامكان تقديرها بالنقد فتقدر من قبل المحكمة، ذلك أن الأصل في الدعاوى أنها معلومة القيمة، فلا تعتبر الدعوى غير قابلة للتقدير إلا إذا كان الطلب فيها يستحيل تقدير قيمته.
وكان الثابت بالأوراق أن المطعون ضده قد أقام الدعوى الأصلية بالمطالبة بمستحقات هي أجوره عن أحد عشر شهراً وبدل الاجازة وبدل العمل الاضافي عن مدة عمله ومكافأة نهاية الخدمة وتذكرة سفره الى موطنه وكذا 20% من نسبته في أرباح المشروعات، وهو وان لم يذكر قيمة هذه الطلبات نقداً الا أنه بالامكان تقديرها بالنقد في ضوء ما قرره بصحيفة دعواه من انه عمل لدى الطاعنة إعتباراً من 1/5/1995 براتب شهري 2700 درهم، أما عن نسبة الأرباح المشار اليها فيمكن تقديرها بحصر هذه المشروعات. وكان الخبير المنتدب في الدعوى قد توصل الى تحديد مستحقات المطعون ضده – بما فيها حصته من الأرباح ومقدارها 64.568 درهماً – بمبلغ اجمالي مقداره 97.843 درهماً، ومن ثم تقدر قيمة الدعوى الأصلية بالمبلغ الآخير، ويكون الطعن بطريق النقض في الحكم الصادر فيها غير جائز عملاً بنص المادة 173/1 من قانون الاجراءات المدنية المعدلة بالقانون الاتحادي رقم 2005.30. أما الدعوى المتقابلة فإن الطعن في الحكم الصادر فيها بدوره يكون غير جائز لسابقة تقدير الطاعنة لها بمبلغ 80.000 درهم، ومن ثم يكون الطعن غير جائز.
Translation - English The court
Whereas, in the facts - and as apparent in the contested judgment and all documents and within the limit of adjudication therein - the respondent has filed the action no. 84/2007 labor partial, Al-Ain, against the appellant corporation requesting to impose upon it to pay his salaries and wages for the last eleven months, his leave allowances for the period of his work, 25% of the project revenues which he made, overtime wages, end service gratuity, and a travel ticket to his homeland on the evidence that he worked with such corporation as a managing director and an engineer against a monthly salary of AED 2700, as from 01/05/1995, but he didn't receive any of his salaries mentioned above nor the 20% of the revenue of each project. Therefore the action was filed.
The court of first instance delegated an expert whose original report was followed by a counter-claim by the appellant requesting to impose upon the respondent to repay an amount of AED 80,000 AED which he borrowed from it and refused to repay them. After the delegated expert submitted his complementary report, the court judged on 14/04/2008 in the original claim to impose upon the appellant to pay an amount of AED 97,843 and travel ticket, and dismissed the counter-claim.
The respondent and the appellant appealed this judgment under appeals no. 133 and 151 of year 2008 Al Ain, and the court of appeal on 08/07/2008 corroborated the appellate judgment. Therefore the cassation was filed.
Whereas Article 173/1 of the Civil Procedures Law - as amended by virtue of Law no. 30/2005 promulgated on 30 November, 2005 and effective as from the date it has been published on 14 December, 2005 and which is applicable to the present claim - stipulates that the “litigants have the right to file a cassation against judgments of the courts of appeal in case the sum of the claim exceeds two hundred thousand Dirham or has no estimated value”, which provision supports that no cassation shall be made in respect of the judgments rendered by the courts of appeal issued after enforcement of Law no. 30/2005 save where the claim value exceeds two hundred thousand AED or cannot be assessed.
Whereas it's proven by virtue of Article 49/1 that in case the value is not in cash while it's assessable in cash, the court shall assess the same. Since, the claims shall be of a recognized value. The claim shall be deemed non assessable only when the request therein cannot be assessed.
Whereas it has been proved in all documents that the respondent filed the original claim requesting dues which are his wages for eleven months, allowance for leaves, overtime wages, end of service gratuity, a travel ticket to his homeland, a rate of 20% of the projects revenues he made. Although the value of these requests was not mentioned in cash, it's possible to assess them in cash in light of what he stated in his claim statement that he worked for the appellant as from 01/05/1995 for a monthly salary of AED 2,700 .
As for the revenue percentage referred to above, it may be estimated by accounting these projects. Whereas the assigned expert on the claim has determined the respondent dues – including his quota of the revenues estimated by AED 64,568 – with a gross amount of AED 97,843. Therefore, the value of the original claim shall be estimated according to the latter amount and the appeal in cassation against the judgment issued for the same shall be invalid pursuant to Article 173/1 of the Civil Procedures Law, amended by the federal law no. 30/2005.
As for the counter-claim, the cassation filed against the judgment issued thereon shall be invalid for because the appellant has previously estimated the same at the amount of AED 80,000 . The cassation therefore is invalid.
