Territorio Indígena y Parque Nacional Isiboro Sécure-TIPNIS.
Señores Comisionados:
En esta audiencia presentaremos la situación de los derechos humanos de los pueblos indígenas del Territorio Indígena y Parque Nacional Isiboro Sécure - TIPNIS, con la intención de ofrecer información actualizada sobre las graves violaciones a los derechos humanos de los pueblos indígenas que habitan el TIPNIS, debido a la construcción de la carretera Villa Tunari - San Ignacio de Mojos atravesando el núcleo del territorio ancestral, nuestra “Loma Santa”.
El Sistema Interamericano de Derechos Humanos, bajo su jurisprudencia, ha avanzado en desarrollar los contenidos mínimos que implican los derechos colectivos al territorio de los pueblos indígenas; con base a la Convención Americana de DDHH interpretada a la luz del Convenio 169 de la OIT y la Declaración de Naciones Unidas sobre los Derechos de los Pueblos Indígenas.
Específicamente, el Art. 23 de la Declaración Americana de los Derechos y Deberes del Hombre, así como el Art. 21 de la Convención Americana de Derechos Humanos, amparan los derechos a la propiedad colectiva del territorio.
Es bajo este desarrollo jurisprudencial, que podemos evidenciar que la forma cómo se ha pretendido implantar dicha carretera atravesando el territorio indígena, vulnera los derechos de libre determinación, al territorio, a la consulta y el consentimiento previo, libre e informado.
1. Antecedentes.
El Territorio Indígena y Parque Nacional Isiboro Sécure (TIPNIS), es un territorio ancestral de los pueblos indígenas Mojeño Trinitario, Yuracaré y T’simane, nuestra “Casa Grande”, que en el año 1965 fue constituido como Parque Nacional, posteriormente en 1990 reconocido como Territorio Indígena y el 2009 es titulado como Tierra Comunitaria de Origen – TCO. Es decir goza de una doble protección, como territorio indígena y como área protegida; cuyos títulos del derecho propietario corresponden colectivamente a la Sub-Central TIPNIS.
Pese a nuestros títulos y en contra de la decisión de los pueblos indígenas del TIPNIS, expresada a través de sus organizaciones representativas, y de conformidad con sus costumbres y tradiciones, el Estado Plurinacional de Bolivia realizó diversos actos legislativos y administrativos como: a) el Decreto Supremo Nº 26996 de 23 de abril de 2003, b) la Ley Nº 3477 de 22 de septiembre de 2006, y c) la Ley Nº 005 de 7 de abril de 2010, destinados a aprobar la construcción de una carretera, cuyo tramo central (tramo II) atraviesa por el TIPNIS, vulnerando nuestros derechos a la libre determinación, el territorio, a la consulta el consentimiento previo, libre e informado.
Estas vulneraciones han llevado a los pueblos indígenas titulares del TIPNIS a la expresa y sistemática oposición sobre dicho proyecto carretero , decisión voluntaria a través de sus instancias tradicionales de representación territorial, y en uso de sus normas y procedimientos propios, a fin de salvaguardar a sus miembros frente a los impactos sociales, ambientales, económicos y culturales que afectarán y devastarán sus vidas como pueblos indígenas, su cultura, su territorio colectivo como medio de vida, el medio ambiente, los recursos naturales y, como Área Protegida, en su ámbito de patrimonio natural y cultural de todos los bolivianos y bolivianas.
Para la defensa de estos derechos territoriales vulnerados, en el 2011 y 2012 los pueblos indígenas del TIPNIS, junto a la solidaridad de otros pueblos indígenas del país, emprendieron dos marchas pacificas desde el territorio indígena hacia la sede de gobierno, la ciudad de La Paz.
Lamentamos señalar ante la CIDH, como ya se tiene registrado, que la VIII marcha de los pueblos indígenas efectuada el año 2011, fue primero estigmatizada y hostigada por autoridades públicas, y luego el 25 de septiembre de 2011, cuando descansaba en el paraje San Lorenzo de Chaparina, fue reprimida e intervenida brutal y violentamente por fuerzas policiales y militares, haciendo uso excesivo y desproporcionado de la fuerza, en franca vulneración de los derechos fundamentales, principalmente a los derechos a la vida, libertad, dignidad, seguridad e integridad personal, a la libre locomoción, así como a sus derechos de libre expresión y asamblea o reunión pacífica. En la VIII marcha fueron víctimas de la represión 687 marchistas, de éste número 250 fueron trasladados por policías y militares hacia la población de Rurrenabaque, donde después fueron liberados ante la presión de pobladores quienes no dejaron que los embarquen en aviones de la Fuerza Aérea Militar. El resto de víctimas se desplazaron y extraviaron al interior del monte, de los cuáles alrededor de 91 eran niñas y niños. Fueron gravemente heridos en esta represión 70 indígenas, según constan los certificados forenses. De tres desaparecidos indígenas, aparecieron después de varios días y búsquedas realizadas, el que correspondía al Consejo de Ayllus y Markas del Qullasuyu (CONAMAQ) y Central de Pueblos Indígenas de La Paz (CPILAP); no obstante, hasta la fecha se desconoce el paradero del hermano indígena de la Central Indígena de Pueblos Originarios de Pando (CIPOA-P), regional del movimiento indígena de Pando.
Cabe mencionar que si bien se abrieron investigaciones, a casi dos años de estos hechos las investigaciones no han concluido y no existen responsables por dicha represión a nuestros hermanos indígenas en Chaparina.
Luego de esos hechos, nuestra marcha se reinició hasta llegar a La Paz, y en diálogo con el gobierno nacional se acordó promulgar la Ley Nº 180 de Protección del TIPNIS, por la que se acuerda suspender la construcción de la carretera y se declara intangible ese territorio.
Sin embargo, a los dos meses, en diciembre de 2011, el gobierno alentó y auspició una (contra) marcha de pobladores campesinos, colonizadores y cocaleros que habitan en la zona de ingreso al TIPNIS, a favor de la carretera, según constan varias apariciones y entrevistas en medios de comunicación, en especial de televisión, de los Senadores Gabriela Montaño y Adolfo Mendoza, quienes trabajaron en esta contra marcha su plataforma y luego la propuesta de esta ley. Cuando ésta llegó también a La Paz en febrero de 2012, en efecto el gobierno promulgó la Ley Nº 222, con la que se convocó a una consulta ad hoc y (posterior a la firma del contrato entre el Estado boliviano y BNDS para el financiamiento de la carretera y, firma de contrato entre gobierno nacional y OAS para su construcción) para darle viabilidad a la carretera, incumpliendo el acuerdo previo de su no construcción.
Es por ello que, en el año 2012, los pueblos indígenas del TIPNIS volvieron a marchar rumbo a la ciudad de La Paz, y luego de una larga caminata llegaron a la sede de gobierno, donde fueron objetos de diversas acciones de presión, estigmatización pública y fraccionamiento mediante dadivas y prebendas, mismas que constan en el relevamiento y registro de información correspondientes a los informes de recorrido por el TIPNIS realizados a la cabeza de la Sub-Central TIPNIS en 2012. Pero además nuevamente son objeto de la represión policial en los días en los que estaban apostados en vigilia en proximidades del Palacio de Gobierno exigiendo la atención de su justa demanda. De esta intervención de la Policía salieron afectadas especialmente las mujeres de la marcha quienes se encontraban en sus campings a momento de la represión, las que fueron víctimas de gases lacrimógenos, palos y chorros de presión de agua. Una líder que sufrió heridas fue Nazareth Flores, presidenta de la Central de Pueblos Indígenas del Beni (CPIB).
Además, en una acción de criminalización de la protesta social, se citó judicialmente a varios de los dirigentes indígenas que participaron en las marchas, dentro de una investigación penal orientada claramente a perseguir y criminalizar sin ningún argumento legal a sus principales líderes. Un dato de ello son las propagandas y publicación que paga y difunde el gobierno sistemáticamente, no solo para descalificar políticamente a quienes considera su oposición y adversarios políticos, sino para acusar de delitos no probados a dirigentes indígenas.
En defensa de estos derechos territoriales e indígenas, la Sub-Central TIPNIS ha tomado acciones de defensa legal, que concluyeron con la Sentencia Constitucional 300, que declara la constitucionalidad de la Ley Nº 222, que paradójicamente aprueba una consulta posterior, pero condicionada al consenso de sus procedimientos de aplicación con los pueblos indígenas titulares del TIPNIS.
El Estado no ha cumplido con las condiciones de consenso y concertación con las instituciones representativas de los pueblos indígenas titulares del TIPNIS, como se tenía señalado en la Sentencia Constitucional 300 y más bien puso en práctica unilateralmente un Protocolo de aplicación para el proceso de consulta con las comunidades, rompiendo, dividiendo y sobrepasando la estructura orgánica de las organizaciones indígenas.
Este proceso de consulta posterior y unilateral fue acompañado por veedores del Órgano Electoral, órgano del Estado que a través del Sistema Intercultural de Fortalecimiento Democrático (SIFDE) emitió un informe lacónico y complaciente que más que mostrar datos veraces sobre la consulta realizada en el TIPNIS, intenta validar el modo de actuar del gobierno nacional, pues en éste se da cuenta que en todas las comunidades visitadas se reclamó y solicitó acceso a la información sobre el proyecto de la carretera, los estudios de impacto ambiental de la obra, y demás temas administrativos que dieron origen al proyecto, los que no son públicos ni conocidos hasta la fecha; por lo que no se puede decir que esta consulta haya sido, al menos, una consulta informada.
También se informó que el gobierno nacional habría invitado a observadores internacionales, pero hasta el presente no se conoce informe alguno que hayan presentado, y éstos nunca consultaron nuestra posición frente a ese ilegal proceso.
Simultáneamente, una Comisión Orgánica conformada por miembros de la CIDOB, de la CEMP-B, de la Sub-Central Sécure, de la Sub-Central TIPNIS, realizaron un recorrido por el TIPNIS, donde verificaron una secuencia de irregularidades y acciones de los funcionarios del gobierno en dicha irregular consulta al no respetar las instancias de representación y las propias estructuras comunales de la toma de decisiones colectivas conforme el uso de sus normas y procedimientos propios de su democracia comunitaria.
Asimismo, el informe alternativo, presentado por la Asamblea de Derechos Humanos y representantes de la Iglesia Católica en Bolivia, acompañados de la Federación Internacional de Derechos Humanos (FIDH), en una misión de verificación en terreno sobre la calidad de la consulta ejecutada por el gobierno, corroboró estos hechos y concluye que:“El proceso de "consulta" del Gobierno no se ha ajustado a los estándares de consulta previa, conforme lo establecen las normas nacionales e internacionales.
De lo expuesto, se identifican múltiples violaciones de los derechos humanos de los Pueblos Indígenas protegidos en la Convención Americana, en particular al derecho a la libre determinación, al territorio, a la consulta previa y al consentimiento previo, libre e informado con respecto a las decisiones que puedan afectarlos.
2. Los derechos de los pueblos indígenas y sus vulneraciones.
Consideramos que el Estado Plurinacional de Bolivia, en este caso y en conexión al derecho al territorio, está vulnerando los siguientes preceptos:
2.1. Derecho a la libre determinación.
Existe una intima relación entre la libre determinación y los derechos territoriales de los pueblos indígenas. Una de sus expresiones es el derecho a determinar libremente su condición política y a perseguir libremente su desarrollo económico, social y cultural.
Los Pueblos Indígenas titulares del TIPNIS hicieron conocer reiteradamente al Estado boliviano su determinación negativa respecto de este proyecto, bajo los siguientes antecedentes:
a) En fecha 16 de Junio de 2004 la Sub-Central de Cabildos del Territorio Indígena Parque Nacional Isiboro Sécure (TIPNIS) mediante la Resolución 003/2004 hizo la petición a las autoridades de no realizar la construcción del corredor Villa Tunari a San Ignacio de Mojos, dado el peligro a la subsistencia de los pueblos indígenas que lo habitan y grave daño socio-ambiental.
b) En fechas 6 y 7 de septiembre de 2008 en la ciudad de Trinidad, Beni se realizó el “XVII Encuentro Extraordinario de Corregidores y Representantes del TIPNIS” en el que se expresaró su rechazo categórico al Proyecto Carretero tramo Villa Tunari - San Ignacio de Mojos, por resultar atentatorio a la integridad territorial del TIPNIS, la conservación de la alta biodiversidad y el desarrollo socio cultural de los pueblos indígenas que habitan ancestralmente la Tierra Comunitaria de Origen.
c) En fecha 6 de abril de 2009, la Sub-Central del TIPNIS, CPEM-B y CIDOB mediante la resolución orgánica expresaron y reiteraron, su pleno rechazo al Proyecto Carretero tramo Villa Tunari - San Ignacio de Mojos, por resultar atentatorio a la integridad territorial del TIPNIS.
d) El 26 de agosto de 2009, la Sub-Central del TIPNIS a través de la Resolución Nº 00014/2009 rechazó la construcción de la carretera en el TIPNIS en el marco de la preservación de la integridad del territorio y de la vida, respeto a los derechos territoriales y al reservorio en el territorio, en función de la visión propia de desarrollo.
e) En los días 17 y 18 de Mayo de 2010, se dio lugar el “XXIX Encuentro Extraordinario de Corregidores de la Subcentral del TIPNIS”, reiteró: “Rechazar contundente e innegociablemente la construcción de la carretera Villa Tunari-San Ignacio de Mojos o todo trazo carretero que afecte el territorio indígena, la casa grande”.
Pese a estas decisiones orgánicas, adoptadas genuinamente por procedimientos propios y mediante las instituciones representativas de los pueblos indígenas del TIPNIS, mismas que fueron elevadas a las autoridades de gobierno como procesos propios, autónomos e internos de toma de decisiones y auto-consulta, las mismas no fueron atendidas, vulnerando el derecho de los pueblos indígenas del TIPNIS a determinar libremente su propio desarrollo.
2.2. Derecho a la propiedad colectiva sobre el territorio.
La Corte Interamericana de DDHH ha señalado que, “debido a la conexión intrínseca que los integrantes de los pueblos indígenas y tribales tienen con su territorio, la protección del derecho a la propiedad, uso y goce sobre éste es necesaria para garantizar su supervivencia”.
La nueva Constitución Política del Estado también reconoce protecciones para el territorio indígena. En su Art. 403 - I, específicamente establece que: “se reconoce la integralidad del territorio indígena, que incluye el derecho a la consulta previa e informada …, la facultad de aplicar sus normas propias, administradas por sus estructuras de representación y la definición de su desarrollo de acuerdo a sus criterios culturales y principios de convivencia armónica con la naturaleza”.
Asimismo, en su Art. 385 II se prevé que “donde exista sobreposición entre áreas protegidas y territorios indígenas, la gestión compartida se realizará con sujeción a las normas y procedimientos de los Pueblos Indígenas.
Así, la propiedad colectiva sobre un territorio indígena, abre a su vez el ejercicio de otros derechos, y cuando esa área coincide con un área protegida, como es el caso del TIPNIS, la gestión del territorio es conforme a las normas y procedimientos propios de la organización indígena. Es decir, el desarrollo de estos territorios se gestiona conforme a su propio “Plan de Vida”, que en el caso del TIPNIS no se ha priorizado ni planificado carretera ninguna.
Es más, la obra fue iniciada sin que existiese el Estudio de Impacto Ambiental, ni la Licencia Ambiental respectiva, la cual para ser otorgada, debía contar con la consulta previa a los pueblos indígenas afectados, en este caso los tres que habitan el TIPNIS.
En el presente caso, con dicha carretera, se está vulnerando los derechos nacionales e internacionales a la propiedad colectiva del territorio. De forma particular el Estado boliviano no ha cumplido con la debida diligencia su deber de asegurar la participación efectiva de los pueblos indígenas ni de elaborar los estudios ambientales, sociales y culturales que identifique de manera cierta, técnica e imparcial los daños e impactos sobre el territorio y las comunidades. Así, quedo establecido del propio informe presentado, en el mes de diciembre de 2012, por el Servicio Intercultural de Fortalecimiento Democrático (SIFDE), en ocasión de la consulta unilateral del gobierno a parte de las comunidades del TIPNIS, ya que todas ellas dejaron establecido que no recibieron la información ambiental suficiente y necesaria.
2.3. Derecho a la consulta previa, libre e informada.
El Derecho Internacional ha establecido el deber general del Estado de consultar previamente a los pueblos indígenas cada vez que tengan que adoptar cualquier medida que pueda afectarles. En la sentencia reciente de junio del año pasado en el caso Sarayaku, la Corte IDH aclaró que una consulta adecuada consiste en una serie de elementos importantes: la consulta debe ser realizada con carácter previo, con la buena fe y la finalidad de llegar a un acuerdo, de manera adecuada, accesible, e informada.
Las fuentes internacionales de derechos humanos son claras: la consulta tiene que ser previa a cualquiera acción u omisión que pueda poner en riesgo los derechos protegidos de los pueblos indígenas. Lo previo es antes, no después.
Como ha señalado esta Comisión, “La consulta de buena fe exige la ausencia de cualquier tipo de coerción por parte del Estado o de agentes que actúen con su autorización,” y la buena fe “también es incompatible con prácticas tales como los intentos de desintegración de la cohesión social de las comunidades afectadas, sea a través de la corrupción de los líderes comunales o del establecimiento de liderazgos paralelos, sea a través de negociaciones con miembros individuales de las comunidades que son contrarias a los estándares internacionales.”
Así, la consulta no es solamente preguntar, sino un proceso culturalmente adecuado de diálogo y negociación que implica la buena fe y la finalidad de alcanzar un acuerdo mutuo.
Sin embargo, al igual que la Ley Nº 222, se adoptó unilateralmente un Protocolo que fue elaborado a “puertas cerradas”, sin lograr la concertación con la organización indígena representativa del TIPNIS, sin cumplir el requisito de buena fe, ya que se construyó un acuerdo espureo con organizaciones aliadas al gobierno, que no representan ni tienen la titularidad del territorio.
El Estado con la acciones y hechos que ha realizado: dividiendo a las comunidades del TIPNIS, distribuyendo prebendas en el territorio, cooptando a algunos de sus dirigentes, desconociendo a las instancias orgánicas y representativas, militarizando el territorio mediante el establecimiento de una base “militar-ecológica”, falta de acceso libre a la información ambiental y de un consenso previo sobre los procedimientos de consulta, etc., no ha dado cumplimiento al derecho a una consulta libre, previa e informada, basado en los parámetros antes indicados.
2.4. Derecho al consentimiento libre, previo e informado.
Los estándares internacionales también nos señalan que en algunas circunstancias, la obtención del consentimiento previo, libre e informado de los pueblos indígenas es jurídicamente obligatorio, como es el caso, entre otros, de la ejecución de planes de desarrollo o de inversión a gran escala, que generen un impacto mayor y sensible en el territorio de un pueblo indígena o afecten sus derechos al territorio.
Dada la naturaleza de esta obra, la afectación sobre una aérea que constituye territorio indígena y área protegida, de alta fragilidad ambiental, su impacto previsiblemente afectará los modos de vida de los pueblos indígenas que habitan ese territorio, poniendo en riesgo su supervivencia cultural, social y económica. Por lo que en este caso, se evidencia una manifiesta vulneración al derecho al consentimiento libre, previo e informado, el cual ya ha sido manifestado reiteradamente por los corregidores y la Sub-Central TIPNIS en cuanto conocieron de este proyecto de carretera y expresamente fue otorgado en ocasión de los acuerdos arribados en ocasión de aprobar la Ley 180, que suspendía la construcción de esta carretera.
3. Conclusiones y Recomendaciones.
Señores miembros Comisión Interamericana de Derechos Humanos - CIDH, expresamos nuestra profunda preocupación por los derechos humanos de los pueblos indígenas del TIPNIS y del patrimonio ambiental de la nación boliviana que están en juego en este proyecto gubernamental. Por ello concluimos con las siguientes recomendaciones:
1. La abrogación de la Ley Nº 222 y sus protocolos y se deje en plena vigencia la Ley Nº180 de protección del TIPNIS.
2. El retiro de inmediato de las fuerzas militares instaladas en el TIPNIS, así como se abstenga de entrar inconsultamente al territorio y sin previa autorización y/o coordinación con la Sub-Central TIPNIS.
3. Se garantice la vida y seguridad de los dirigentes indígenas en el Departamento del Beni, especialmente en San Ignacio de Mojos.
4. Se procese a quienes instigaron, ordenaron y ejecutaron las acciones racistas en San Ignacio de Mojos en mayo de 2012 al paso de la IX Marcha, así como que se culmine con el proceso de investigación por la represión policial en Chaparina en contra la VIII Marcha Indígena en el 2011, imponiendo sanciones a los responsables.
5. La CIDH realice a la brevedad posible una visita in loco a Bolivia, en especial al TIPNIS para elaborar un informe imparcial, consultando a todas las partes, sobre la situación de los derechos humanos de los pueblos indígenas que los habitan después de la realización de la consulta posterior y unilateral del gobierno.
6. Se exhorte al Estado Plurinacional de Bolivia ajuste sus actos en el TIPNIS a la Convención Americana de Derechos Humanos, en especial en lo referido al respeto a la propiedad territorial, así como a la normativa internacional y a los estándares de derechos humanos de los pueblos indígenas, los cuales protegen y garantizan el derecho irrestricto a la vida, la libre determinación, la consulta y consentimiento libre, previo e informado, respetando el derecho propio a la cultura, el desarrollo y reconociendo a las instituciones representativas de los pueblos indígenas; derechos además garantizados por la Constitución Política del Estado vigente y promulgada por el Presidente Evo Morales Ayma.
7. Se suspenda toda obra, medida o actividad para la construcción del tramo II de la carretera Villa Tunari - San Ignacio de Mojos, en tanto el gobierno cumpla con la vigencia de los derechos humanos de los pueblos indígenas y transparente su política para este megaproyecto, conforme a lo prescrito en los instrumentos y estándares internacionales.

Translation - English Human Rights of the Indigenous Peoples living in the
Isiboro Sécure National Park and Indigenous Territory - "TIPNIS."
Esteemed Commissioners:
In this hearing, we will present the human rights situation of the indigenous peoples of the Isiboro Sécure National Park and Indigenous Territory (TIPNIS). Our intention is to offer up-to-date information about the grave human rights violations against the indigenous peoples that inhabit TIPNIS, due to the construction of the Villa Tunari - San Ignacio de Moxos Highway, which will pass through the heart of our ancestral territory, our "Loma Santa.”
The Inter-American Human Rights System, through its jurisprudence, has developed the minimum implications of the indigenous peoples' collective rights to territory, based on the American Convention on Human Rights, interpreted in light of Convention No. 169 of the ILO (International Labour Organization) and the United Nations Declaration on the Rights of Indigenous Peoples.
More specifically, the collective ownership rights of the territory are protected by Article No. 23 of the American Declaration of the Rights and Duties of Man, and by Article No. 32 of the American Convention on Human Rights.
It is in consideration of this jurisprudence that we can provide evidence that the manner in which the Bolivian government has attempted to install the aforementioned highway through indigenous territory violates the right to self-determination, the right to territory, and the right to prior, free, and informed consultation and consent.
1. Background.
The Isiboro Sécure National Park and Indigenous Territory (TIPNIS), is an ancestral territory of three groups of indigenous peoples: the Mojeño Trinitario, the Yuracaré, and the T'simane. Our "Casa Grande, ” was declared a National Park in 1965. It was later recognized as an Indigenous Territory in 1990, and in 2009, it was titled a Native Community Land (TCO: Tierra Comunitaria de Origen). In other words, TIPNIS possesses double protection, as an indigenous territory, and as a protected area. Its ownership titles are held collectively by Subcentral TIPNIS.
In spite of our ownership of the territory and against the decision of the TIPNIS indigenous peoples (expressed by our representative organizations in accordance with our customs and traditions), the Plurinational State of Bolivia enacted various legislative and administrative acts--such as a) Supreme Decree No. 26996 of April 23rd, 2003, b) Law No. 3477 of September 22nd, 2006, and c) Law No. 005 of April 7th, 2010--approving the construction of a highway. The central segment of the highway (segment II) would pass through TIPNIS, violating our rights to self-determination, to territory, and to prior, free, and informed consultation and consent.
These violations have brought the title-holding indigenous peoples of TIPNIS to an express and systematic opposition to this highway project. Their opposition is a voluntary decision reached through traditional spheres of territorial representation, and according to their own norms and procedures. They oppose the highway project to safeguard their members against social, environmental, economic, and cultural impacts which would alter and devastate their lives as indigenous peoples, their culture, the collective territory on which they subsist, the environment, and the area's natural resources. Also, as TIPNIS is a national Protected Area, the highway threatens the natural and cultural heritage of all Bolivian people.
In defense of these violated territorial rights, the indigenous peoples of TIPNIS, along with other indigenous peoples of the country acting in solidarity, set out on two peaceful marches, one in 2011 and one in 2012, from the indigenous territory to the capitol city of La Paz.
We regret to point out before the IACHR, as it is already on record, that the eighth march of indigenous peoples in 2011 was first stigmatized, then harassed by public authorities. Later, on the 25th of September, 2011, while the march rested at San Lorenzo de Chaparina, police and military forces intervened with brutal violence to repress the marchers. They used excessive and disproportionate force, in blatant violation of fundamental human rights, chiefly the rights to life, dignity, personal safety and integrity, to free movement, and of freedom of expression and peaceful assembly. 687 participants were victims of the repression of the eighth march. Of this group, 250 were physically removed by the police and military and taken to Rurrenabaque, where they were later set free due to pressure from local residents, who would not allow them to embark on Military Air Force airplanes. The remaining victims were lost in the wilderness; approximately 91 of them were children. According to forensics, 70 indigenous people were seriously injured. Of three indigenous persons missing, two appeared after days of searching, one of whom was a member of the Ayllus and Marcus National Council of Qollasuyo (CONAMAQ), and the other from the Center of Indigenous Peoples of La Paz (CPILAP). To this day, the location of the third indigenous person, a member of the Indigenous Center of the First Amazonian Peoples of Pando (CIPOA-P), a regional organization of the Pando indigenous movement, is still unknown.
It should be mentioned that even if investigations were opened, they have yet to be completed almost two years later and no one has been held responsible for this brutal repression of our indigenous brothers in Chaparina.
Our march continued after these events until reaching La Paz. In talks with the national government, an agreement was reached for the promulgation of Law No. 180 for the Protection of TIPNIS, which calls for the suspension of the highway's construction and declares the territory intangible.
However, within two months, in December of 2011, the government encouraged and backed a (counter) march of rural settlers and coca growers that inhabit the border areas of TIPNIS in favor of the highway. The government’s support for this march was apparent invarious media appearances, especially television interviews with Senators Gabriela Montaño and Adolfo Mendoza, who built their political platforms, and later the proposal of this law, around the march. When the counter march arrived in La Paz in February of 2012, the government promulgated Law No. 222, with which it convened an ad hoc consultation and made the highway project viable, with the help of two important contracts. One contract was signed between the Bolivian state and the Brazilian National Development Bank (BNDS) for the funding of the highway, and the other between the national government and OAS for its construction. Law No. 222 effectively undid the previous agreement which forbid the construction of the highway.
In response, the indigenous peoples of TIPNIS again marched toward La Paz in 2012. When they arrived at the capital after another long journey, they were pressured, publicly stigmatized, and divided by bribes and payoffs. All of this information can be found in field reports from a trip throughout TIPNIS conducted by Subcentral TIPNIS in 2012. They again were victims of police repression in the days that they were positioned near the Federal Palace demanding a response to their just demands. The women of the march, who were found at their camping sites when the repression began, were especially affected by this police intervention. They were beaten by police and attacked with tear gas and high pressure hoses. One female leader who suffered injuries from this attack was Nazareth Flores, president of the Central Office for Indigenous Peoples from Beni (CPIB).
Additionally, in an act of criminalization of social protest, various indigenous leaders who participated in the march were charged. The charges, having no legitimate legal basis, were clearly meant to persecute and villainize these major leaders for their participation in the march. Evidence of this campaign can be found in the propaganda funded and systematically disseminated by the federal government, not only to politically disqualify the opposition and political adversaries, but also to make unfounded criminal accusations against indigenous leaders.
In defense of these indigenous and territorial rights, Subcentral TIPNIS took defensive legal action, culminating in Constitutional Judgment 300. The judgment declared the constitutionality of Law No. 222, and paradoxically approved a posterior consultation, but on the condition that an agreement be reached with the title-holding indigenous peoples of TIPNIS on the procedures for the consultation.
The State has not complied with these conditions of consensus with the representative institutions of the title-holding indigenous peoples of TIPNIS, as outlined in Constitutional Judgment 300. It has instead unilaterally enacted a Protocol for the process of consultation with the communities, breaking, dividing, and transcending the natural structure of the indigenous organizations.
This process of unilateral posterior consultation was overseen by observers from the Electoral Authority, a body of the State that emitted a laconic and accommodating report through the Inter-cultural System of Democratic Strengthening (SIFDE). Instead of outlining valid data about the consultation in TIPNIS, it sought to justify the actions of the national government. From this report, we see that access to information about the highway project, as well as environmental impact studies and allother administrative matters which gave rise to the project, was demanded by all of the communities visited. This information has yet to be released to the public, so it cannot be said that this consultation was an informed one.
The report also claimed that the national government had invited international observers, but they have yet to present any reports and they have never consulted us about our position against this illegal process.
Simultaneously, an Organic Commission was convened, made up of members of the Confederation of Indigenous Peoples of Bolivia (CIDOB), of the Central Office for Native Mojeño Peoples (CEMP-B), of the Subcentral Sécure, and of the Subcentral TIPNIS. This commission completed a tour of TIPNIS and audited a series of irregularities and the actions of the government agents in the aforementioned consultation. It was found that the state functionaries did not respect the the representative organizatio, nor the structures for collective decision-making set in place by the rules and regulations of the community democracies.
Additionally, the alternative report, presented by the Assembly of Human Rights and representatives of the Catholic Church in Bolivia, along with the International Federation of Human Rights (FIDH), on a mission to expose the quality of the government's consultation, corroborated these facts and concluded that: "The process of 'consultation' by the government did not conform to the national and international standards of prior consultation."
From the facts presented, we can identify multiple violations of the human rights of the Indigenous Peoples protected by the American Convention, in particular the rights to self-determination, to the territory, and to prior, free, and informed consultation and consent with respect to decisions that could affect their livelihood.
2. The rights of indigenous peoples and the violations of those rights.
We consider that the Plurinational State of Bolivia, in this case and with respect to territorial rights, is violating the following precepts:
2.1. The right to self-determination.
There is an intimate relationship between self-determination and the territorial rights of the indigenous peoples. One of its expressions is the right to freely determine their political condition and to freely pursue their economic, social, and cultural development.
The title-holding Indigenous Peoples of TIPNIS have repeatedly made their rejection of this project known to the Bolivian State, as seen in the following history of events:
a) On June 16th, 2004, the Subcentral of Councils of TIPNIS, through Resolution 003/2004, petitioned authorities not to complete construction of the Villa Tunari - San Ignacio de Moxos Highway, given the danger it would present to the subsistence of the indigenous peoples inhabiting TIPNIS and the grave social and environmental damage it would cause.
b) On September 6th and 7th, 2008, the "XVII Special Meeting of TIPNIS Leaders and Representatives" took place in the city of Trinidad, Beni. In this meeting, the TIPNIS representatives expressed their categorical rejection of the Villa Tunari - San Ignacio de Moxos Highway Project, due to the threat it posed to the territorial integrity of TIPNIS, to the conservation of its high biodiversity, and to the sociocultural development of the indigenous peoples inhabiting the Native Community Land.
c) On April 6th, 2009, Subcentral TIPNIS, CPEM-B, and CIDOB, by means of organic resolution, expressed and reiterated their complete rejection of the Villa Tunari - San Ignacio de Moxos Highway Project for the threat is posed to the territorial integrity of TIPNIS.
d) On August 26th, 2009, Subcentral TIPNIS, in Resolution No. 00014/2009, rejected the construction of the highway in TIPNIS, in the name of the preservation of life and territorial integrity, with respect to territorial rights and the reservoir in the territory, based on their own vision of development.
e) On May 17th and 18th, 2010, the "XXIX Special Meeting of TIPNIS Leaders and Representatives" once again reiterated: "The conclusive and non-negotiable rejection of the construction of the Villa Tunari - San Ignacio de Moxos Highway, and any highway plot that affects the indigenous territory, "la casa grande".
Unfortunately, the government did not respect these organic decisions which were genuinely adopted by the representative institutions of the indigenous peoples of TIPNIS through their own legal procedures (procedures that were guaranteed by government authorities to be legitimate, autonomous, and internal methods of decision-making and self-consultation). The decisions were ignored, violating the right of the TIPNIS indigenous peoples to determine their own development.
2.2. The right to collective ownership of the territory.
The Inter-American Court of Human Rights has declared that "due to the intrinsic connection that the tribal and indigenous peoples have with their territory, the protection of their land ownership, use, and enjoyment rights is necessary to guarantee their survival."
The new Bolivian Constitution also recognizes protections for the indigenous territory. In Article 403 - I, the Constitution specifically states that: "the wholeness of the indigenous territory is recognized, which includes the right to prior and informed consent..., the ability to apply their own laws, administrated by their own structures of representation, and the definition of their development in accordance with their cultural standards and principles of living in harmony with nature."
Article 385 II additionally states that "where there is an overlap between protected areas and indigenous territories, the shared management of these regions will be subject to the rules and regulations of the Indigenous Peoples."
This means that the collective ownership of an indigenous territory implies the exercise of additional rights, and when the region is also part of a protected area, as in the case of TIPNIS, the management of the territory must comply with the rules and regulations of the indigenous organizations. In other words, the development of these territories must be carried out in compliance with the territory's own "Plan de Vida," which, in the case of TIPNIS, does not include the construction of any highways.
What's more, the highway project was initiated without the release of an Environmental Impact Study or the respective Environmental License, which, to be granted, would require the prior consultation of the indigenous peoples affected: in this case, the three groups that inhabit TIPNIS.
In the present case concerning said highway project, the national and international rights to the collective ownership of the territory are being violated. The Bolivian State, in particular, has not fulfilled with proper diligence its obligation to ensure the effective participation of the indigenous peoples in this matter, nor has it completed the environmental, social, and cultural studies necessary to identify the impacts and damages to the territory and its communities in a valid, unbiased, and scientific manner. This was demonstrated in the aforementioned report from the Inter-Cultural Service of Democratic Strengthening (SIFDE) in December of 2012. The report showed the unilateral consultation of the government without input from the TIPNIS communities, all of whom established that they did not receive sufficient necessary environmental data.
2.3. The right to prior, free, and informed consultation.
International Law has established the general duty of the State to previously consult indigenous peoples each time that it plans to take measures that could affect them. In a precedent set by the case of Sarayaku last June, the Inter-American Court of Human Rights clarified that an adequate consultation consists of several important elements: the consultation must be performed in an appropriate, accessible, and informed method, prior to taking action, in good faith, and with the goal of reaching an agreement.
International human rights sources are clear: consultation must occur prior to any action or omission that could compromise the protected rights of indigenous peoples. Prior means before, not after.
As the Commission has stated, "A consultation in good faith demands the absence of any type of coercion on the part of the State or its agents," and good faith "is also incompatible with practices such as the disintegration of the social cohesion of the affected communities, whether by corruption of the community leaders or the installment of parallel leadership, or by negotiations with individual community members that do not meet international standards."
As we have shown, consultation does not mean simply asking permission. It is rather a culturally adequate process of dialogue and negotiation, in inherent good faith and with the goal of reaching a mutual agreement.
However, in accordance with Law No. 222, the government unilaterally adopted a Protocol which was conducted "a puertas cerradas. " The government did not reach an agreement with the representative organization of the TIPNIS indigenous people, nor did it meet the requirement of good faith since it made an illegimate agreement with organizations already allied with the government and which were not title-holding owners of the territory.
The Bolivian State, through its actions (dividing the TIPNIS communities, offering bribes to members and leaders, ignoring the organic decisions of the representative organizations, militarizing the territory with establishment of an "eco-military" base), as well as its lack of open access to environmental information and lack of prior consent to the procedures of the consultation, etc., has not complied with the right to a free, prior, and informed consultation, as outlined previously.
2.4. The right to free, prior, and informed consent.
International standards also note that in some circumstances it is a legal obligation to obtain free, prior, and informed consent from indigenous peoples. Such is the case, among others, in the execution of large-scale investments or developmental plans, which have a greater and noticeable impact on the territory of indigenous peoples or compromise their rights to the territory.
Given the nature of this project and the effects it would have on an indigenous territory and protected area of such high environmental fragility, its impacts would forever change the way of life of the indigenous peoples of the territory, putting their social, cultural, and economic survival at risk. That is why this case presents a clear violation of the right to free, prior, and informed consent. This point has been argued repeatedly by the representatives of Subcentral TIPNIS since they first became aware of the highway project, and was explicitly expressed during the negotiations of the agreements reached with the passing of Law No. 180, which suspended construction of the highway.
3. Conclusions and Recommendations.
Esteemed members of the Inter-American Commission on Human Rights - IACHR, we wish to express our deep concern for the human rights of the TIPNIS indigenous peoples and for the environmental heritage of the entire Bolivian nation, both of which come into play in this governmental project. In light of these concerns, we would like to conclude with the following recommendations:
1. The repeal of Law No. 222 and its protocols, and the reinstatement of Law No. 180 for the protection of TIPNIS.
2. The immediate withdrawal of the military forces in place in TIPNIS, which in the future will not enter the territory without prior authorization and/or coordination with Subcentral TIPNIS.
3. The guarantee of the life and safety of the indigenous leaders in the Beni Department, especially in San Ignacio de Moxos.
4. The criminal processing of those who instigated, ordered, and executed the racist actions at San Ignacio de Moxos in May of 2012 during the Ninth March, as well as the completion of the investigation into the police repression against the Eighth Indigenous March at Chaparina in 2011, bringing sanctions against those responsible.
5. That the IACHR complete an in loco visit to Bolivia as soon as possible, to TIPNIS in particular, to prepare an unbiased report, consulting all parties involved. The report should cover the current human rights situation of the indigenous peoples following the posterior and unilateral consultation carried out by the government.
6. The demand that the Plurinational State of Bolivia adjust it laws concerning TIPNIS to the standards of the American Convention on Human Rights, especially with respect to territorial ownership. It should also be required to adjust to the international norms and standards for the human rights of indigenous peoples, which protect and guarantee the unrestricted rights to life, to self-determination, and to prior, free, and informed consultation and consent, respecting their right to their own culture and development, and recognizing their representative organizations, rights which are additionally guaranteed by the current Constitution enacted by President Evo Morales Ayma.
7. The suspension of all works, measures, or activities for the construction of Segment II of the Villa Tunari - San Ignacio de Moxos Highway, while the government complies with the validity of the human rights of the indigenous peoples and clarifies its policy for this megaproject in accordance with international standards.
