Source text - English 8. Confidentiality / Data protection
The translator commits to treat in a confidential manner all the client's documents, especially the source recordings and texts.
Unless otherwise expressly indicated, the translator has the right to consider that the client accepts electronic handling and non encrypted transmission of the translation over the Internet. Consequently, the risks related to data protection, pirating, risks of modification and / or loss of data are supported entirely by the client.
9. Royalties
The client grants to the translator the required rights to translate the source text. The client guarantees that he has such rights and will indemnify the translator if third parties engage prosecutions about these rights.
The translator grants the client the right to dispose of the translation for the use agreed in the contract. Any other use will need the translators approval, which he won't refuse if the use respects the author's moral rights and is paid for accordingly.
If it is customary for the type of text, the client must mention the translator's name if the translation is published.
The client may change the translation. However, if these changes are not insignificant, he must notify the translator, who has the right to waive his right to have his name mentioned.
The translator has the right to use the source text and the translated text as well as any document supplied by the client as tools, allowing him to establish glossaries, word lists or text blocs, rendered anonymous, to supply his translation memoires and/or transfer them to third parties.

Le traducteur s’engage à traiter de manière confidentielle les
documents du client, notamment les enregistrements et les textes de
départ.
Sauf déclaration expresse contraire, le traducteur a le droit de
considérer que le client accepte le traitement électronique et la
transmission électronique non cryptée de la traduction par internet.
Par conséquent, les risques liés à la protection des données, le
piratage, les risques de modification et de perte de données encourus
sont supportés par le client.
9. Droits d’auteur
Le client accorde au traducteur les droits requis pour traduire le texte
de départ. Le client garantit disposer desdits droits et indemnisera le
traducteur si des tiers engagent contre ce dernier des poursuites à ce
sujet.
De ses droits d’auteur créés par la traduction, le traducteur accorde au
client le droit d’utiliser la traduction dans le but identifiable par lui à la
conclusion du contrat. Toute autre utilisation nécessite son
consentement qu’il ne refuse pas si l’utilisation respecte le droit moral
de l’auteur et est rémunérée comme il se doit.
Lorsque c’est l’usage pour ce type de texte, le client doit dûment
mentionner le nom du traducteur si la traduction est publiée.
Le client peut remanier la traduction. Cependant, si la reformulation
n’est pas insignifiante, il doit en informer le traducteur, qui a le droit
de renoncer à la mention de son nom.
Le traducteur a le droit d’utiliser le texte de départ et le texte
d’arrivée ainsi que la documentation fournie par le client comme
instruments de travail lui servant à établir des glossaires, des listes de
mots ou des blocs de texte sous forme rendue anonyme pour
alimenter des mémoires de traduction et/ou les transmettre à des
tiers.
