All employees are expected to know the regulations contained in the Code and the relevant rules governing activities performed in their respective functions.
Employees shall:
• refrain from all conduct contrary to such rules and regulations;
• consult their superior, or the Guarantor, whenever clarifications concerning the implementation of said rules are needed;
• immediately report to their superiors or to the Guarantor:
- any fact that comes to their direct, or indirect, knowledge concerning a possible violation of such rules;
- any request they receive to violate such rules;
• cooperate with the relevant office or department in ascertaining any violations.
If, after notifying a supposed violation, an employee should deem that the issue has not been fully investigated or feels that he or she has been subject to retaliation, then the employee shall be entitled to make a complaint to the Committee for the Code of Practice.
Employees are not allowed to conduct personal investigations, nor to exchange information, except to their superiors, the Guarantor or the Committee for the Code of Practice.
1.4 Additional duties of managers
Each manager shall:
• act in a way that shall serve as an example of good conduct to his or her subordinates;
• encourage employees to respect the Code and to raise relevant questions and issues relating to the Code;
• act in such a way as to demonstrate to employees that respecting the Code is an essential aspect of the quality of their work;
• in so far as it is possible, try to select employees and external collaborators in such a way that will prevent assignments being given to persons who cannot be relied upon to implement the Code;
• immediately report the discovery of any possible deviations from the Code to a Senior Manager or to the Guarantor. Likewise, any information on possible deviations that is received from subordinates must also be passed on immediately to Senior Management;
• immediately take corrective measures whenever necessary;
• prevent any kind of retaliation.
Translation - German 1,3 Verpflichtungen der Mitarbeiter
Von allen Mitarbeitern wird erwartet, dass sie die in dem Kodex enthaltenen Regelungen sowie die entsprechenden Regeln für die Ausübung der Tätigkeiten in ihrer jeweiligen Position kennen.
Die Mitarbeiter sollen:
• jedes Verhalten unterlassen, das diesen Regeln und Regelungen widerspricht;
• sich an ihre Vorgesetzten oder den Bürgen wenden, falls bei der Umsetzung der genannten Regeln Klärungsbedarf besteht;
• ihren Vorgesetzten oder dem Bürgen sofort Bericht erstatten, wenn:
- sie direkt oder indirekt Kenntnis über eine mögliche Verletzung dieser Regeln erhalten;
- sie dazu aufgefordert werden, diese Regeln zu verletzten;
• mit dem jeweiligen Büro oder der Abteilung bei der Ermittlung von Verletzungen zusammenarbeiten.
Wenn ein Mitarbeiter, nachdem er eine von ihm vermutete Verletzung wahrgenommen hat, der Meinung ist, dass die Angelegenheit nicht vollständig untersucht wurde, oder wenn er glaubt, dass er aus Vergeltung unter Druck gesetzt wird, hat der Mitarbeiter das Recht, eine Beschwerde beim Ausschuss für den Verhaltenskodex einzureichen.
Mitarbeiter dürfen weder auf eigene Faust Untersuchungen anstellen, noch Informationen austauschen, ausgenommen gegenüber ihren Vorgesetzten, dem Bürgen oder dem Ausschuss für den Verhaltenskodex.
1.4 Zusätzliche Verpflichtungen der Führungskräfte
Jede Führungskraft sollte:
• so handeln, dass sie gegenüber den von ihr geführten Mitarbeitern als Beispiel guten Verhaltens gelten kann;
• Mitarbeiter zur Einhaltung des Kodex ermutigen und relevante Fragen und Probleme bezüglich des Kodex ansprechen;
• mit ihrem Handeln den Mitarbeitern demonstrieren, dass die Einhaltung des Kodex ein wichtiger Bestandteil zur Sicherung der Qualität ihrer Arbeit ist;
• es bei der Auswahl von Mitarbeitern und externen Kooperationspartnern so weit wie möglich vermeiden, Aufträge und Anstellungen an Personen zu vergeben, auf die bei der Umsetzung des Kodex kein Verlass ist;
• die Aufdeckung eines möglichen Verstoßes gegen den Kodex sofort einem Mitglied der Geschäftsleitung oder dem Bürgen melden. Ebenso müssen alle Informationen über mögliche Verstöße, die die Führungskraft von unterstellten Mitarbeitern erhält, sofort an die Geschäftsleitung weitergegeben werden;
• sofortige Korrekturmaßnahmen einleiten, wann immer sie erforderlich sind;
• jede Art von Racheakten verhindern.
