Mi scuso con Oscar se dissento dalla stragrande maggioranza, ma io lo tradurrei in questo modo. Secondo me l'indicativo è la scelta ideale per questa frase. Rende meglio il senso, senza complicazioni.
Per Roberta, secondo me "shall have effect so as to limit liability" puoi tranquillamente semplificarlo con "potrà limitare la responsabilità"
