German term

weitere Vollstreckung

German to English Law/Patents Law (general)
The following appears at the top of a letter from the leitende Oberstaatsanwalt to the Justizministerium

Weitere Vollstreckung der gegen den deuschen Staatsngehörigen [Name] in Grossbritannien verhängten Freiheitsstrafe in der Bundesrepublik Deutschland

Does this mean that the sentence was imposed in Germany and weitere Vollstreckung will be in GB given that the first line of the letter proper says Der Verurteilte verbüßt die Rest-Einheits-Jugendstrafe in Höhe von 581 Tagen seit dem 24.03.2006 in der Justizvollvollzugsanstalt Bielefeld-Brackwede 1? If so the first part does not seem quite right or is it just me?!!

Thanks for any help

Discussion

LegalTrans D Jan 3, 2007:
Just to point you in the right direction, Helen -- split up the sentence like this: "...der...in Großbritannien verhängten Strafe..."; i.e., the sentence was imposed in GB. "Weitere Vollstreckung...[of the sentence]...in der Bundesrepublik Deutschland."
Kim Metzger Jan 3, 2007:
Please also take the time to classify your questions properly - law (not "other").
Kim Metzger Jan 3, 2007:
Please enter the term you're having trouble with instead of "help with sentence". Something's got to be entered in the glossary.

further enforcement

The UK legal system uses the word "enforcement" to indicate Vollstreckung. "Execution" is a more specialist term (e.g. execution by Court bailiffs of a warrant). It is also the term used in the EU Convention:
EU Principles on Jurisdiction and Recognition and Enforcement of ...The European rules on jurisdiction and recognition and enforcement of judgments in civil and commercial matters, laid down in EU Regulation (44/2001), ...

3 KudoZ points awarded for this answer. Comment: "Thanks and special thanks to Volkmar who solved my problem with unravelling the sentence"

continued enforcement

seems to me that a sentence passed in GB remains effective in Germany.

Further execution

Vollstreckung = execution (Romain dictionary of legal and commercial terms)
