This is from a legal rebuttal to charges of a violation of state aid provisions brought by the European Commission.

Im Falle der - nicht ersichtlichen - Unvereinbarkeit einer Beihilfe könnte die Kommission theoretisch auch die Rückforderung des wirtschaftlichen Vorteils (und nicht etwa die Übereignung der Infrastruktur) anordnen. In beiden hypothetischen Fällen wäre die Begünstigung aber beihilfenrechtlich ausgeurteilt worden. Der XXX stünde es dann vollkommen frei, wie sie mit der Infrastruktur weiterhin wirtschaften will.
