French term

oppose en compensation ses créances en dommages

French to English Law/Patents Law: Contract(s) payment and damages,
Cela étant précisé, C. oppose en compensation ses créances en dommages
et interest

The complete paragraph:

All I can come up with is " This having been clarified, C. offsets its claims against compensatory damages" I have no other apart from the fact that P. is keeping objects to which he has no right.

Thanks for your remarks.
Nikki Scott-Despaigne May 8, 2016:
On "compensatory damages" Damages (which as Adrian points out) include interest in UK contexts, at least. You can have damages by way of compensation, or compensation, or damages. However, "compensatory damages" has no meaning in UK contexts.

(does hereby) set up (raise or plead) by way of set-off the latter's claims for damages

optionally, damages + interest, just in case of a client query as to whether interest is included.

BTW, in EN law, it's the equitable (so discretionary) doctrine of partial or full set-off - points lost on the 2nd web ref that, paradoxically, claims that the is oftidea en misunderstood.

that the idea is often misunderstood...
Peer comment(s):

agree Nikki Scott-Despaigne : A (very slightly) more economic rendering : "hereby offers his/her/its claims for dammages by way of set-off".

Thanks and merci. I'm unsure that damages in E&W claims include interest that, routinely, need to be claimed at a rate 'pursuant to statute'.

use claims for damages as compensation

Creances are claims for money (here as damages) that off-set compensation.
