Tuttavia, la possibilità per il giudice di ricorrere ai c.d. fatti notori sussiste solo ed esclusivamente nel caso in cui si tratti di fatti acquisiti alle conoscenze della collettività, in un dato tempo e luogo, con tale grado di certezza da apparire indubitabile ed incontestabile. Tipico esempio di fatto notorio è la svalutazione monetaria.
