Growing trees, crops and fruits are also immovable but become moveable when severed from the soil.” Immovable by destination are objects which would normally be movables but which are considered to be immovable by reason of their attachment to immovable property. Article 337 provides, “Moveable things which a proprietor has placed on his real property for a permanency or which he has incorporated therewith, are immoveable by their destination so long as they remain there.” For a movable to be so classified it has to meet three requirements: (1) affixation by owner of the immovable; (2) destination; (3) intention to immobilize the movable. Immovable by attachment is provided for in article 338 of the Civil Code.
