The general duty to avoid conflicts of interest
The trustee has an obligation not to permit conflicts of interest either between two competing fiduciary duties, or between the trustee’s personal interests and the interests of the beneficiaries. At one level, therefore, a trustee is not permitted to refrain from any action as trustee which would otherwise have been carried out, nor to take any action which would otherwise not have been performed, on the basis that the trustee’s behavior was motivated by a conflict between her personal interests and her countervailing fiduciary obligations.
