"El estándar probatorio para el dictado de un auto de vinculación a proceso se redujo de manera importante porque no se requiere un cúmulo probatorio amplio, en razón de que el Ministerio Público no presenta pruebas formalizadas para acreditar el hecho y menos la responsabilidad del indiciado, sino sólo hace referencia a datos probatorios que establezcan, en grado de suposición, que se ha cometido un hecho que la ley señale como delito y que exista la posibilidad real de que la persona implicada lo cometió o participó en su comisión; por ende, si esa determinación judicial se realiza en función de hechos que el órgano técnico de acusación pone en conocimiento del Juez de control y, en su caso, la contra-argumentación o refutación del imputado o su defensor, deben apreciarse como indicios que sólo sirven para integrar datos, que al ser valorados como parte del ejercicio racional del juzgador, expresan el grado de credibilidad que le proporcionan; de ahí que es innecesario exigir un mecanismo para reforzar o perfeccionar los datos de prueba que existen en la carpeta de investigación o que los doten de mayor credibilidad, para que adquieran el carácter de indicios razonables y sean susceptibles de adquirir valor demostrativo, como por ejemplo, el que se demuestre que el suscriptor de una opinión pericial tiene los conocimientos técnicos para realizar ese cometido."
