Defendant and Minuter

Szkocki wyciąg z wyroku odnośnie dziecka stron.
Jedna strona to Pursuer and Respondent a druga Defendant and Minuter.

W angielskiej procedurze byłoby apelant and respondent.

angielski term (edited): minuter (Scots law)
Selected

skarżąca proceduralna

Pursuer (Petitioner in E&W / 'South of the Border') = turned Respondent ( AmE: Appellee) on appeal: here IMO on a 'minute', namely an incidental, interlocutory appeal or ancillary objection on some procedural matter and that, in many countries, stays the proceedings, namely holds up trial until it is resolved by being adjudicated on.

Confusingly in English law, Respondent is on the other side to the Petitioner as well as on Appeal.

The second : a druga is the *Defender* in Scots law = turned Minuter as an Appellant or filer of a (procedural) motion (French: incident d'instance') .

Minute: a document which is part of the process by which a party defines his or her position on certain *procedural* matters e.g. by abandoning the action/ Terminology of Scots Law.
Example sentence:

The person who raises the initial action remains as the Pursuer throughout the case. An extra description such as "minuter" or "respondent" is added to show what that person is actually doing in subsequent documents

The Sheriff (Scottish Judge), having considered the pursuer's and minuter's *motion*, number 7/5 of process, Dispenses with service of the motion and minute of amendment on the *defender* and respondent, thereafter, Grants same ..
