Polish term or phrase: dyspozycyjność
Artykuł z zakresu historii prawa:

"Polscy prawnicy byli w pełni świadomi ewolucji, jaką przeszedł proces cywilny w XIX w. Francuski wzór organizacji procesu cywilnego służył bowiem zabezpieczeniu autonomii woli stron w nawiązywaniu stosunków prywatnoprawnych i ich ochronie w postaci naczelnych zasad procesowych, jakimi były skargowość, kontradyktoryjność i dyspozycyjność."

autonomy of the parties

Explanation:
The principle of formal truth implies that the evidence presented by the parties should correspond to the factual and legal findings done by the court.646
- principle of equality of the parties which means each party is equal and have equal rights to undertake an action in the proceeding
- principle of the autonomy of the parties (dyspozycyjność) which is shown in capacity to freely decide about their material and procedural rights, i.e. the decision to avail oneself of a right is at the holder’s discretion.

cccccccccccc There are a number of arguments undermining ... the close connection between the subject of a trial and the ability to conclude a judicial settlement. First, a trial is conducted in the interest of the plaintiff, and pursuant to the principle of party initiative [dyspozycyjność] it generally lies within the plaintiff’s discretion to commence or continue prosecuting the action.

The changing fate of Polish civil procedure did not threaten the heritage of Polish jurisprudence. *****The adversarial and dispositive principles*****, as well as the principle of oral proceedings and the principle of the free appraisal of evidence were constantly present in the Polish legal system. Nevertheless, after World War II some significant modifications were imposed that limited the autonomy of the parties and the independence of the court owing to the political subordination to the Soviet Union. However, the attitude of the majority of Polish lawyers enabled many standards of the classic judicial proceedings to be maintained, and thereby also the relations with the European doctrine of procedural law.

Of course, the above could be an incorrect translation.

Reference: Zasada autonomii woli stron ≠ zasada dyspozytywności (postępowania cywilnego)

Reference information:
