We wniosku do sądu okręgowego. W podpunktach jest wypisane co ustanawia sędzia okręgowy i między innymi jest "grants warrant to cite witnesses and havers.". Jakieś pomysły?

W sumie są jeszcze dwa miejsca, których nie jestem pewna. The sheriff dispenses with service on the child or any other person for due to his young age." Tu nie jestem pewna jak to service przetłumaczyć.

I ostatnie "The Sheriff appoints answers to be lodged..." To be lodged?

Jesli to są banalne pytania, to przepraszam. Zazwyczaj nie biorę się za prawnicze teksty, ale w połowie tłumaczenia wkradł mi się taki jednostronicowy chochlik.

haver - to - generalnie - posiadacz --- posiadacz prawa --- więc może ostatecznie - uprawniony (zgodnie z ze szkocką nomenklaturą) ?

modum probationis - to coś jakby - działanie w trybie sporządzania dowodu ...
... ale, koledzy prawnicy potrzebni :)

Marco, ten właściciel aktu notarialnego nie do końca chyba odpowiada tej definicji z wordnika ( In Scots law, the holder of a deed or writing, who is called upon to produce it judicially, in modum probationis, or for inspection in the course of a process.), co? Tu chodzi nie tylko o akty notarialne i ta osoba jest również wezwana do sądu w celu przedstawienia dokumentu, a właściciel aktu notarialnego tego raczej nie oddaje.

Haver - The person in possession of a document or property from whom a party to proceedings wishes to obtain it for the purposes of the proceedings.

Recovery of documents - Where documents are sought to be used to prove a case and are in the possession of another party in the case or some person who is not a party, they may be sought to be recovered by that other person on application to the court. The person who is said to be in possession of the document is called a "haver". A motion for recovery of documents must be accompanied by a document called a specification of documents which sets out the documents or categories of documents sought to be recovered.

Haver - A person having documents in his possession which he is required to produce as evidence in litigation as a result of commission and diligence procedure.

Commission & Diligence - Eng: Disclosure (although English Disclosure has a much wider application) An application to the court to obtain documents (listed on a Specification of Documents) held by an opponent or third party (called a haver)

This is an outdated Scottish or English legal term that basically means "Possessor" or one who "has possession and or control." In some places it may also mean the holder of a deed or lien.
