Streamlined Forensic Drugs Report SFR Stage 1 Forensic Result

SFRs assist courts to fulfil their duty, to further the overriding objective of the CrimPRs, by ensuring that evidence is presented in the shortest and clearest way and by facilitating the early identification of the real issues.
The prosecution propose to rely on the forensic evidence contained in this SFR and if there is a trial, to adduce it by way of a s10 CJA 1967 admission to the general effect that the exhibit/s listed were forensically examined and the examination produced the result/s described.

It is important to distinguish between formal and informal admissions. An informal admission (which does not meet the statutory requirements of s10 of the Criminal Justice Act 1967) is a statement made by the defendant which is adverse to his/her case. It is admissible as evidence of the truth of what is admitted although, unlike a formal admission, informal admissions are not conclusive proof. An example of an informal admission is a statement made by a defendant during a PACE interview which undermines the defence case.

Section 10
Section 10 provides for proof by formal admission in criminal trials. Unlike a statement admitted under section 9, an admission under section 10 is conclusive evidence.

Requirements

An admission under section 10 made before the proceedings must be in writing; if it is made orally during the proceedings it must be written down in accordance with Part 27 Criminal Procedure Rules 2010.

Admissions under section 10 should relate to facts. Expressions of opinion, speculation and comment, should be avoided.
