Hola chicos,

Hoy me asaltan de nuevo las dudas con estos dos verbos. De los apuntes de la facu de hace unos años, tenía entendido que rescindir era dar por nulo el contrato, como si nunca hubiera existido, y volver al estado inicial (ej. anulación de matrimonio) mientras que resolver era dejar el contrato sin efectos pero sin volver al estado inicial (ej. en una resolución de contrato de trabajo, el trabajador no devuelve el sueldo, ni el jefe las horas trabajadas).

Recuerdo hace un tiempo una página que decía que "terminate" no debía traducirse por "rescindir"; era una de esas páginas de Apuntes o Punto y Coma o similares que versaba sobre los errores típicos en la redacción de un contrato, lo agregué a mis favoritos (creo) pero entre mi caos personal y que fue hace muchos años no lo encuentro por ningún lado. También recuerdo haber leído por ahí algo de que la diferencia entre ambos estribaba en la causa. La verdad es que millones de veces he leído en traducciones (y he traducido yo misma) "termination" como "rescisión", sin más, pero hoy de nuevo tengo dudas, y querría vuestra opinión al respecto. Y más porque en el texto que estoy traduciendo hay una distinción entre "cancellation" y "termination".

RESOLVER = LLevar a efecto una resolución (DRAE)

RESOLUCIÓN = Decreto, providencia, auto o fallo de autoridad gubernativa o judicial.
RESOLUCIÓN JUDICIAL FIRME = (Der.) Aquella que, por no ser susceptible de recurso, se considera como definitiva.

En cuanto a los términos ingleses "termination" y "cancellation", te sugiero que plantees tus dudas en el par "English-Spanish".
De todas formas, intentaré resolvértelo aquí en breve.

\"anulación/cancelación\" y se emplean indistintamente, pero realmente no lo son.

Aquí creo que explica claramente la diferencia en el caso de una licencia o permiso:

The major difference between cancellation and termination of a permit is that **a CANCELLATION is CARRIED OUT WITH THE CONSENT OF THE PERMITTEE** while **TERMINATIONS may be EFFECTED WITHOUT THE CONSENT OF THE PERMITTEE**. The Bureau of Water will cancel an ND permit in two situations. The first cancellation situation is when a facility closes and/or eliminates its land application site(s) and the permittee requests that the permit be canceled. The second situation is when a permit expires without the permittee reapplying for the permit. In both situations, the Bureau will inactivate the permit.
