预告登记

Chinese to English Law/Patents Real Estate realty registration
预告登记制度在《物权法》通过后正式进入实践。这一制度具有很强的作用,所以我想用英文写一点介绍性的文字向国外人士介绍这一制度。但首当其冲,如何用英文表达“预告登记”却一筹莫展。

我目前想到的就是"pre-registration"这个词语,google显示有国外的文献在使用,但我无法证实其是否与国内的这个“预告登记”是一回事。

一、不动产预告登记的涵义及价值
不动产预告登记制度对应于本登记,是为补充不动产登记公信力的缺陷而设立的一种制度。不动产预告登记是指,当事人所期待的不动产物权变动所需要的条件缺乏或者尚未成就时,法律为保全这项将来发生的以不动产物权变动为目的的请求权进行的登记。不动产预告登记最早为德国民法所创立,随后的瑞士、日本和我国台湾地区的民法均采纳了该项制度。即使在某些英美法系国家,尽管适用范围不完全相同,也有相似的一类制度称为 “Registration of Caution”(警告登记)。

somehow, I will say this is reasonable, bringing out the substance of this legal system. However, I did notice such translation used by many, but I do not like it, since it was used in different circumstance and for different purpose. http://www.thestage.co.uk/connect/eagle/1211.php On the other hand, I am not expecting a further and better answer to this question.
Still I will simply go for the term, "pre-registration", simple and making sense. Thanks guys.

pre-notice registration

第二十条 当事人签订买卖房屋或者其他不动产物权的协议,为保障将来实现物权,按照约定可以向登记机构申请预告登记。预告登记后,未经预告登记的权利人同意,处分该不动产的,不发生物权效力。

    预告登记后,债权消灭或者自能够进行不动产登记之日起三个月内未申请登记的,预告登记失

Article 20 Where concerned parties reach an agreement pertaining to purchase or sale of a house or other real properties, it may, in order to ensure realization of property rights, apply for pre-notice registration with the relevant registration department in accordance with the agreement. Upon completion of the pre-notice registration, the disposal of such real property without consent from the obligee of the pre-notice registration shall not take effect with regard to property rights.

Upon the registration of the pre-notice, the creditor’s rights lapses or within three (3) months from the date on which such registration can be registered, but fails to apply for registration of real property within, the pre-notice registration shall become null and void.

Scope of Pre-registration System Expanded:The Property Law has expanded the scope of China’s real property pre-registration system. The Property Law provides that parties who enter into a contract for the sale and purchase of real property or other forms of immovable property may, for the purpose of protecting the establishment of relevant property rights, apply for pre-registration with the registration authority. After pre-registration has been completed for a particular property, the registered owner of the property may not sell the property to a third party without consent from the party whose interest in the property has been registered. Note that pre-registration under the Property Law becomes ineffective if the underlying property right is extinguished or a registration application is not made within three months following the pre-registration.

In contrast under current rules, pre-registration is principally available only in connection with sales by a developer of residential property where the developer has obtained a pre-sale permit.

In principle, the pre-registration system under the new law will help protect the interests of buyers of real property during the interim period between contract signing and formal registration of the transfer of property rights.

'pre-registration' sounds good to me (covers the period between signing the contract of sale and purchase and registration of the title in the purchaser's name. ) The above two law firms, Jones Day and Morrison and Foerster, use this term.

While "Registration of Caution" may hold sway in Taiwan, "Advance Notice Registration" seems to be entrenched usage on the mainland.
