Latvian term

Atdalīšanas princips

Latvian to English Law/Patents Law: Contract(s)
Vai kāds lūdzu zin, kā angliski pareizi sauc šo juridisko terminu? Nozīmē princips to, ka, ja kāds no līguma punktiem izrādās spēkā neesošs, pārējie līguma noteikumi paliks spēkā.

Severability principle

Iziet no šādas definīcijas:

Severability clause:
A provision in a contract that preserves the rest of the contract if a portion of it is invalidated by a court. Without a severability clause, a decision by the court finding one part of the contract unenforceable would invalidate the entire document.
Example sentence:

The district court’s analysis, however, which was reversed by the Ninth Circuit, was, according to the Court, consistent with the Buckeye Check Cashing and Prima Paint severability principle.
