Spanish term

cualidades personales

Spanish to English Law/Patents Law (general) Marriage Certificate
I think this is body language. But maybe someone has a better fit?

Context:

Translation:

4. Marriages of mistaken identity by either spouse, or instances in which certain body language may lead one to believe that the marriage may not be consensual.

Discussion

Jim Morrissey (asker) Apr 18, 2013:
Thanks - I reread it and body language sounds odd now. I was struggling with this - I got the gist, but obviously need to fine tune it.
Richard Hill Apr 18, 2013:
I get the impression that it's where a spouse misleads the other to believe he/she is something he/she is not

Wow, you beat me to the punch!
teju Apr 18, 2013:
I agree with Rich, I don't think they are talking about body language. It sounds more like his/her personality. I would go with a literal translation since it preserves the ambiguity of the original: personal traits.
Richard Hill Apr 18, 2013:
personal characteristics/traits perhaps?
Richard Hill Apr 18, 2013:
Not sure what this means yet but I can't see any law annulling a marriage based on body language

personal characteristics

An option. I think that "cualidades personales" is broad enough to include not just body language but also mental capacity and such. Suppose a questionable marriage took place involving a person with Down syndrome. That is certainly a "cualidad personal" -- not body language.

personal traits

Under our law, concealments and misrepresentation as to personal traits and moral character do not amount to fraud which can annul a marriage. . . . Misrepresentations of social and financial positions are insufficient. . . . Nor do false concealments and misrepresentations as to source of funds. . . . The same is true of false vows of love and affection. (citation omitted). Id. at 768.

A contract of marriage may be avoided when brought about by artifice or fraudulent practices, but concealment of personal traits or habits, or vices or bodily health or other infirmities like the habit of kleptomania, is not ground for avoiding a marriage. Lewis v Lewis, 44 M 124, 46 NW 323.
