El tipo de actividades a desarrollar en el proyecto científico referido, no se enmarcan dentro de la regulación en materia de impacto ambiental, que se fundamenta en las actividades que se señalan en el Reglamento de la Ley General del Equilibrio Ecológico y la Protección al Ambiente en materia de Evaluación de Impacto ambiental (RLGEEPA-EIA), en su Capítulo II DE LAS OBRAS O ACTIVIDADES QUE REQUIEREN AUTORIZACIÓN EN MATERIA DE IMPACTO AMBIENTAL Y DE LAS EXCEPCIONES.
Donde el Artículo 5. dice- Quienes pretendan llevar a cabo alguno de las siguientes obras o actividades, requerirán previamente la autorización de la Secretaría en materia de impacto ambiental:
En su inciso L) EXPLORACIÓN, EXPLOTACIÓN Y BENEFICIODE MINERALESYSUSTANCIAS RESERVADAS A LA FEDERACIÓN, se encontró en la fracción II referencia a las actividades señaladas en el proyecto de investigación referido y dicho inciso dice:
