job description/duties as set out in the job description//employment agreement Explanation: Employment agreement is the larger term. Contained within is a job description, which lists the duties of an employee. Examples: .................................... Each job should have a written job description and person specification. These should be reviewed every time a vacancy occurs to ensure that they remain relevant and are flexible, including making reasonable adjustments should people with disabilities apply. Job descriptions describe an employee's role, what is required to do the job and not how they do it or their personal contribution. Accurate job descriptions provide the basic building blocks on which the recruitment process is built http://www.rcn.org.uk/support/pay_and_conditions/agendaforch... ccccccccccccccccccccccccccccccccccc Mandatory clauses In order for an individual employment agreement to meet the minimum requirements by law, it must contain at least the clauses listed below, or a derivation thereof. Duties Example - Duties as set out in the job description The Employee shall perform the duties set out in the Job Description attached to this agreement. http://www.dol.govt.nz/er/starting/relationships/agreements/... ccccccccccccccccccccccccccccccccccccccccccccccccccccccccccccccc What to put in employment agreements Describing the duties Make sure you describe the core duties as set out in the job description and if applicable, mention all the tasks the employee will be required to complete. |

contract of employment Explanation: as an employee – under contract of employment -------------------------------------------------- Note added at 1 day12 hrs (2014-05-13 23:03:14 GMT) -------------------------------------------------- "Osoba taka może wskazać podmiot, u którego wykonywała stale czynności jako faktycznego pracodawcę, w takim przypadku sąd ocenia jak w rzeczywistości przebiegało wykonywanie tych zadań i czy można orzec o tym, że były one wykonywane w reżimie pracowniczym." ...as employer ... duties were performed/services were rendered... whether they performed these duties as an employee (under a contract of employment/an employment contract) https://www.google.pl/?gfe_rd=cr&ei=lKNyU-6EKeSH8QfAiYHwCQ#q... https://www.google.pl/?gfe_rd=cr&ei=lqRyU465KeGH8QfSvoGgCw#q... -------------------------------------------------- Note added at 1 day16 hrs (2014-05-14 02:33:28 GMT) -------------------------------------------------- Natomiast w niniejszej sprawie wobec braku jakiejkolwiek dokumentacji świadczącej o fakcie podjęcia zatrudnienia w 1970 roku, nie sposób jedynie na podstawie zeznań świadka A. P. i zeznań wnioskodawcy, złożonych w charakterze strony, ustalić istnienia stosunku pracy w okresie od dnia 20 czerwca do dnia 31 sierpnia 1970 roku. |

employment-like setting Explanation: Definition of ‘employee’ considered: Federal Court (...) Given that On Call has failed to satisfy me that the relationship between it and the panel interpreters is not an employment relationship, it logically follows that On Call has failed to satisfy me that the relationship is not employment-like. I have come to that view including by reference to a consideration of the underlying purpose of the Superannuation Guarantee [(Administration)] Act of facilitating occupational superannuation for workers who sell their labour in employment and employment-like settings. Even if I had been satisfied that panel interpreters were not common law employees, on the findings I have made, I would nevertheless have been satisfied that they are workers personally performing work in an employment-like setting. http://www.workplaceinfo.com.au/recruitment/employment-contr... |
