penal sanctions apply

I think this simply means that the duty of confidentiality carries penal sanctions if it is breached.

Sanktionere can mean either approve or impose sanctions - it is a bit ambiguous both in English and Danish, so ´strafsanktioneret´ emphasises that it is the reference to a penalty that applies here.
