Zur Erlaüterung meines Vorschlags : Im Grunde ist ein Patentanspuch (claim) nichts anderes als die Beschreibung dessen was nach Antrag des Anmelders unter Schutz gestellt werden soll. Diese Beschreibung wird z.B. nach Paragr. 14 deutsch. PatG zur Auslegung der Patentansprüche herangezogen. (Im englischen Text oben handelt es sich offenbar um eine Auslegungsfrage hinsichtlich der Beschreibung des Patentanspuchs in preamble und body of the claim ). Was ich meinte war, daß "body of the claim" den Hauptteil des in der Anmeldung oder dem Antrag (auf Erteilung des Patents) beschriebenen Anspruchs bezeichnet. |
