It is noted that you acknowledge the X messages referred to in our first letter confirming that our client’s payments were intended for Y as beneficiary, and therefore it is clear from these that your client had at least constructive notice of that the payment was made by mistake, and hence held the benefit of the account as constructive trustee for our client, and in the alternative that our client has a claim for money had and received from against the Bank.
