Eu diria "pleitear em juízo" no Brasil, sem sobra de dúvidas. Em Portugal, não sei como seria mais adequado.

Segundo o dicionário Black's Law Dictionary, "to fill a claim" é apresentar um pedido com vista a indemnização, o que me parece que até poderia encaixar aqui, pois dado o contexo - roubo de informações bancárias - faria sentido.

Sobre como se diz em pt-pt (o que não é pedido na pergunta) habitualmente dizemos "instaurar um processo/uma acção judicial", mas há outras maneiras de o dizer.
