Επί ακινήτου ή ιδανικού μεριδίου αυτού ή εμπράγματου δικαιώματος επί ακινήτου ή ιδανικού μεριδίου αυτού που αποκτάται με οποιαδήποτε αιτία μετά την 1.1.2006 και μετά την κτήση αυτή μεταβιβάζεται περαιτέρω με επαχθή αιτία, επιβάλλεται φόρος αυτομάτου υπερτιμήματος (Φ.Α.Υ.) στη διαφορά μεταξύ της τιμής κτήσης αυτού και της τιμής πώλησής του. Ως κτήση του ακινήτου νοείται η αγορά ή η με άλλη αιτία κτήση του, ανεξάρτητα από τη μεταγραφή της.
