The answer to the conflict of rules is given by the principle of the hierarchy, according to which the most favorable rule to the worker shall prevail. It is a theory created in opposition to the accumulation theory once, in the latter, one chooses the most favorable norm contained in each conflicting collective instrument, and each rule is applied to the employment agreement in an isolated manner.
