Celebrated as the granary of Kerala, Palakkad is a vast expanse of verdant plains interspersed with hills, rivers, mountain streams and forests. The gateway to Kerala from the north, a 40 kilometre break in the mountains known as the Palakkad Gap gives access to this land situated at the foot of the Western Ghats. Idiopathic inflammatory myopathies (IIMs) are a heterogeneous group of acquired, systemic connective tissue diseases characterized by chronic inflammation of striated muscles leading to predominantly proximal muscle weakness.
They are best classified on the basis of their varying clinical characteristics into the most common subsets of IIM: adult dermatomyositis (DM) and polymyositis (PM), juvenile DM, necrotizing autoimmune myositis, myositis in overlap with cancer or another connective tissue disease, and inclusion body myositis.
IIMs are frequently associated with constitutional symptoms and commonly involve other organ systems including the skin, joints, lungs, gastrointestinal tract and heart.
Patients with IIM have increasing difficulty with tasks requiring the use of proximal muscles, such as getting up from a chair, climbing steps, or lifting objects.
In rare acute cases also respiratory muscles can be affected.
Extra-muscular disease activity may manifest in systemic symptoms like fever, arthralgia, and Raynaud’s phenomenon, cardiac arrhythmias or ventricular dysfunction, and pulmonary complications, primarily due to interstitial lung disease (reported in 10-40% of patients).
IIMs are rare with an estimated incidence of 4-10 cases/million population per year, and a bimodal incidence pattern reflecting childhood onset of juvenile DM and a later peak in adulthood.
Each IIM subtype has a different prognosis and response to therapies so that the distinction from other diseases is very important.
Although the precise pathogenesis is unknown, the IIMs likely result from immune-mediated processes initiated by environmental factors in genetically susceptible individuals.
Although a spectrum of severity exists for DM, this entity is more likely to be associated with rapid and aggressive myositis.

JUSTICE GORSUCH delivered the opinion of the Court.
As the Great Depression took its toll, struggling railroad pension funds reached the brink of insolvency. During that time before the modern interstate highway system, privately owned railroads employed large numbers of Americans and provided services vital to the nation’s commerce. To address the emergency, Congress adopted the Railroad Retirement Tax Act of 1937. That legislation federalized private railroad pension plans and it remains in force today. Under the law’s terms, private railroads and their employees pay a tax based on employees’ incomes. In return, the federal government provides employees a pension often more generous than the social security system supplies employees in other industries.
Our case arises from a peculiar feature of the statute and its history. At the time of the Act’s adoption, railroads compensated employees not just with money but also with food, lodging, railroad tickets, and the like. Because railroads typically didn’t count these in-kind benefits when calculating an employee’s pension on retirement, neither did Congress in its new statutory pension scheme. Nor did Congress seek to tax these in-kind benefits. Instead, it limited itself to taxing employee “compensation,” and defined that term to capture only “any form of money remuneration.”
It’s this limitation that poses today’s question. To encourage employee performance and align employee and corporate goals, some railroads (like employers in many fields) have adopted employee stock option plans. Typical of many, the plan before us permits an employee to exercise stock options in various ways—purchasing stock with her own money and holding it as an investment;
purchasing stock but immediately selling a portion to finance the purchase; or purchasing stock at the option price, selling it all immediately at the market price, and taking the profits. The government argues that stock options like these qualify as a form of taxable “money remuneration” under the Act because stock can be easily converted into money. The railroads reply that stock options aren’t “money” at all and remind us that when Congress passed the Act it sought to mimic existing industry pension practices that generally took no notice of in-kind benefits.

You know the game, don’t you? The little buggers are diabolical. They are not, repeat not, your natural friends. They can smell it when you’re going to teach a real lesson on grammar or something, and they’ll head you off at the pass, baby. Watch ’em. Those kids have been at this for years, eleven or twelve, and they have teachers all figured out. They’ll know if you’re even thinking about grammar or spelling, and they’ll raise their little hands and put on that interested expression and ask you what games you played as a kid or who do you like for the goddam World Series. Oh, yeah. And you’ll fall for it. Next thing is you’re spilling your guts and they go home not knowing one end of a sentence from the other, but telling the moms and dads about your life. Not that they care. They’ll get by, but where does that leave you? You can never get back the bits and pieces of your life that stick in their little heads. Your life, man. It’s all you have. Tell ’em nothing.
The advice was wasted. I learned through trial and error and paid a price for it. I had to find my own way of being a man and a teacher and that is what I struggled with for thirty years in and out of the classrooms of New York. My students didn’t know there was a man up there escaping a cocoon of Irish history and Catholicism, leaving bits of that cocoon everywhere.

Source text - English 2.4. In the event of termination of the rights of the Right Holder to the company name and commercial designation without replacing them with new similar rights, this agreement shall terminate as if the Right Holder or User were declared bankrupt.
2.5. The transfer to another person of any exclusive right included in the complex of rights granted to the User does not entail a change in the conditions or termination of the contract. The new Right Holder becomes a party to this agreement in terms of rights and obligations relating to the alienation of exclusive rights.
2.6. If the Right Holder changes the company name or commercial purpose, the rights to use of which are included in the complex of exclusive rights, the contract shall remain valid with respect to the new company name (or commercial designation) of the Right Holder, if the User does not require termination of the contract and compensation for losses. If the contract continues, the User has the right to demand a corresponding reduction in the remuneration due to the Right Holder.
2.7. The Right Holder has the right to refuse to conclude a contract for a new term, provided that within 5 (five) years from the date of expiration of the contract he will not conclude similar contracts with other persons and will not agree to conclude similar contracts, the validity of which will apply to the same territory on which the contract has expired. If, before the end of the 5-year period, the Right Holder wishes to grant someone the same rights that were granted to the User under the contract, that has expired, he is obliged to offer the User to conclude a new contract or to compensate for the losses incurred by the User. When concluding a new contract, its conditions should be no less favorable for the User than the terms of the contract that has expired.

В случае продления действия соглашения Пользователь вправе потребовать соответствующим образом уменьшить сумму вознаграждения, причитающуюся Правообладателю.
2.7. Правообладатель вправе отказаться от заключения соглашения на новый срок при условии, что в течение пяти (5) лет со дня истечения срока действия настоящего соглашения он не заключит аналогичные соглашения с другими лицами и не согласится на заключение аналогичных соглашений, действие которых распространяется на ту же территорию, на которой имело силу прекратившее действие соглашение. Если до окончания пятилетнего периода Правообладатель пожелает предоставить иному лицу те же права, которые были предоставлены Пользователю по прекратившему действие соглашению, Правообладатель будет обязан предложить Пользователю заключить новое соглашение или компенсировать убытки, понесенные Пользователем. Условия нового соглашения с Пользователем должны быть не менее выгодными, чем условия прекратившего действие соглашения.
