Hello. From a review of a book on "actiones negotiorum gestorum".

"ajenidad" is used extensively in my source text to describe the "pertaining-to-somebody-else-ness" of affairs which are managed by the agent (on the principal's behalf)

For example:

"Sin embargo, esta exigencia no es mantenida por aquellos juristas –muy claramente Ulpiano- que incluyen en este esquema las actuaciones realizadas sui lucri causa y depraedandi causa, es decir, en interés propio aunque consciente de la *ajenidad* de la cuestión.

I translated this in a roundabout way: "...for one’s own interests despite being aware that the affairs are somebody else’s", but I would like to find a better alternative, if possible, particularly for subsequent sentences such as:

"Por todo ello, en opinión del a., el único elemento subjetivo indiscutible para el ejercicio de la acción civil es la ajenidad del negocio."

Any ideas? Thanks for your help :)

Hi. A comment:

"ajenidad" in this instance cannot refer to non-involvement or foreignness, as the agent in question is deeply involved in (and no foreigner to) the affairs of the prinicpal. In fact they are managing their affairs (the principal may be absent, dead or a prisoner of war etc.).

Apologies if I didn't explain this properly, it's quite a complex issue!

foreignness

I would suggest the use of this term in your second example because both "ajeno" and foreign have the same shades of meaning. Thus, it would be ... is its foreignness to the business (or enterprise).

I believe that “alienness” is used with a similar meaning in philosophy of law.

I've been looking into some of my books on the Roman family and law and can't really find any one short, sexy phrase that would fit, but this is what kept coming to mind. Hope it helps.

The verb would of course change depending on the context, as might "another's" be changed for a more specific person.
