Source text - Portuguese A tutela jurídica dos animais iniciou-se num primeiro momento no continente europeu nos séculos XVIII e XIX, ganhando maior destaque a partir do século XX. No Brasil, a expressão maior deste segmento apareceu com o Decreto n°24.645 de 1934, onde em seu artigo 3°foram assegurados a proteção contra os maus tratos e elencados as hipóteses em que seriam aplicadas às disposições legais. Posteriormente, foi elaborado o Decreto N° 30.691 de Março De 1952, que pode ser considerado o marco jurídico específico do bem estar animal, vez que versava sobre o Regulamento da Inspeção Industrial e Sanitária de Produtos de Origem Animal.
No campo do bem estar animal, além da aplicabilidade da Lei Federal, o Ministério da Agricultura por intermédio de instruções normativas regula o tema, especificamente na Instrução Normativa n° 56 de Novembro de 2008, que estabelece os procedimentos gerais de Recomendações de Boas Práticas de Bem-Estar para Animais de Produção e de Interesse Econômico abrangendo os sistemas de produção e o transporte - REBEM.
Apesar de teoricamente a legislação brasileira ter evoluído significativamente nos últimos anos, o país ainda encontra-se anos luz da atual realidade dos países desenvolvidos, que admitem em seus mercados apenas produtos submetidos a um rígido controle de qualidade e em conformidade total com suas resoluções e demais leis, matérias inclusive, de Direito Internacional em que o Brasil ratificou acordos para exportação de nossa matéria prima.
Na prática, entretanto, a situação se torna problematica; embora existam diplomas legais sua aplicabilidade é muito limitada. Não existem fiscalizações eficientes, profissionais qualificados e vontade política para que se reverta a situação. A instrução normativa n° 56 foi bem clara:
Art. 3º Para fins desta Instrução Normativa, deverão ser observados os
seguintes princípios para a garantia do bem-estar animal, sem prejuízo do cumprimento, pelo interessado, de outras normas específicas:
I - proceder ao manejo cuidadoso e responsável nas várias etapas da vida do animal, desde o nascimento, criação e transporte;
II - possuir conhecimentos básicos de comportamento animal a fim de proceder ao adequado manejo;
III - proporcionar dieta satisfatória, apropriada e segura, adequada às
diferentes fases da vida do animal;
IV - assegurar que as instalações sejam projetadas apropriadamente aos sistemas de produção das diferentes espécies de forma a garantir a proteção, a possibilidade de descanso e o bem-estar animal;
V - manejar e transportar os animais de forma adequada para reduzir o
estresse e evitar contusões e o sofrimento desnecessário;
VI - manter o ambiente de criação em condições higiênicas.
Não distante da letra da Lei, Diomar Ackel Filho, na sua obra Direito dos Animais assim traz:
“(...) os direitos dos animais constituem expressão da própria Natureza, do bem e do justo e, por conseguinte, traduzem-se em valores éticos da humanidade , que ao sistema jurídico positivo cumpre assimilar para efetiva normatização. Assim, alimentada pela Moral, a lei poderá impor sanções concretas para os infratores e permissões jurídicas expressas para a tutela processual dos direitos subjetivos dos animais, já que eles não são meras coisas, mas sujeitos de direito. ’’
Portanto este trabalho, objetiva expor a distância entre a realidade brasileira e a dos países desenvolvidos, apontando algumas críticas no atual sistema de produção , observar os reflexos do bem estar em outros campos do direito e proporcionar uma visão geral sobre esta realidade muitas vezes esquecida.
Translation - English The legal protection of animals began at first on the European continent in the 18th and 19th centuries, gaining greater prominence from the 20th century onwards. In Brazil, the greatest expression of this segment appeared with Decree No. 24.645 of 1934, where protection against ill-treatment and the hypotheses in which the legal provisions would be applied were listed in its 3rd article. Subsequently, Decree No. 30.691 of March 1952 was drawn up, which can be considered the specific legal framework for animal welfare, as it dealt with the Regulation of Industrial and Sanitary Inspection of Products of Animal Origin.
In the field of animal welfare, in addition to the applicability of Federal Law, the Ministry of Agriculture regulates the subject through normative instructions, specifically, Normative Instruction No. 56 of November 2008, which establishes the general procedures for Recommendations of Good Practices for Farm Animal Welfare and of Economical interest in the production and transport systems - REBEM.
Although theoretically Brazilian legislation has evolved significantly in recent years, the country is still light years away from the current reality of developed countries, which admit in their markets only products subject to strict quality control and in full compliance with their normative resolutions and other laws, including matters of International Law, in which Brazil ratified agreements for the export of our raw material.
In practice, however, the situation becomes problematic; although there are legal diplomas, their applicability is very limited. There are no efficient inspections, qualified professionals or political will to reverse the situation. Normative Instruction No. 56 was very clear:
Art. 3º For the purposes of this Normative Instruction, the following principles must be observed for ensuring animal welfare, without prejudice to compliance by the interested party with other specific rules:
I - proceed with careful and responsible handling in the various stages of the animal's life, from birth, rearing and transport;
II - possess basic knowledge of animal behavior in order to proceed with proper handling;
III - provide a satisfactory, appropriate and safe diet, adequate to the
different stages of the animal's life;
IV - ensure that the facilities are designed appropriately for the production systems of the different species in order to guarantee protection, the possibility of rest and animal welfare;
V - handle and transport the animals properly in order to reduce the stress and avoid bruising and unnecessary suffering;
VI - maintain the breeding environment in hygienic conditions.
Not far from the letter of the law, Diomar Ackel Filho, in his work entitled Animal Rights, states:
“(...) the rights of animals are an expression of Nature itself, good and fair and, therefore, translate into ethical values of humanity, which the positive legal system must assimilate for effective regulation. Thus, fueled by Moral, the law will be able to impose concrete sanctions for violators and express legal permissions for the procedural protection of the subjective rights of animals, since they are not mere things, but subjects of law. ''
Therefore, this work aims to expose the distance between the Brazilian reality and that of developed countries, pointing out some criticisms in the current production system, to observe the reflections of well-being in other fields of law, and to provide an overview of this often forgotten reality.

Source text - English The need for productivity increase in the agricultural sector demands, more and more, the utilization of insecticides to control infestations. Among them, there is carbofuran, which has high toxicity for mammals and its exposure may cause serious harm to health. With the objective of evaluate the toxicity of this compound through subchronic exposition by an intraperitoneal injection in Wistar rats, this work has dosed the activity of this enzyme through the potentiometric method, as well as analyzed the behavioral modifications of rats exposed to the carbofuran during the forced swimming test. The levels of carbofuran absorption were evidenced by a decrease of cholinesterase activity around 37,2%( p=0,037). This effect probably relates to the behavioral alterations that were observed during the forced swimming test, which demonstrates an average time of immobility from the animals of the carbofuran group significantly higher than the control group, (F1,12=7,01267, P=0,021252) which shows a depressive state known as “learned helplessness” on the group exposed to the insecticide. Therefore, it is noticed that after exposure to carbamate there was a significant depression of acetylcholinesterase activity, which probably led to increased concentrations of acetylcholine in the central nervous system and consequently to increased cholinergic activity in this tissue. This change possibly interfered with the animal's behavior as demonstrated in the test.
Translation - Portuguese A necessidade do aumento da produtividade na área agrícola requer, cada vez mais, a utilização de inseticidas para o controle das infestações. Dentre eles, observa-se que o carbofuran apresenta elevada toxicidade e sua exposição pode ocasionar sérios agravos à saúde. Com o objetivo de avaliar a toxicidade deste composto através da exposição subcrônica pela via intraperitoneal em ratos Wistar, o trabalho dosou a atividade desta enzima por meio do método potenciométrico, assim como, analisou as modificações comportamentais dos ratos expostos ao carbofuran através do teste do nado forçado. Os níveis de absorção do carbofuran foram evidenciados pelo decréscimo da atividade colinesterásica em torno de 37,2% (p=0,037). Este efeito provavelmente se relaciona com as alterações comportamentais que foram observadas através do teste do nado forçado, que demonstrou um tempo médio de imobilidade dos animais do grupo carbofuran significativamente maior do que o do grupo controle, (F1,12=7,01267, P=0,021252), o que torna evidente um estado depressivo conhecido como “desamparo aprendido” no grupo exposto ao inseticida. Assim, nota-se que após a exposição ao carbamato houve uma depressão significativa da atividade da acetilcolinesterase, o que provavelmente levou ao aumento das concentrações de acetilcolina no Sistema Nervoso Central e consequentemente ao aumento da atividade colinérgica neste tecido. Esta alteração possivelmente interferiu no comportamento do animal conforme ficou demonstrado no teste.
